Here's my report. 2 years ago on Feb 2 americredit with the help off J&M recovery services proceeded to reposess my 2003 Nissan sentra se/r. That same night i called americredit who explained to me why the car was taken. It was because i supposed was more than 2 months behind which was a lie. They were very rude and disrespectful. I explained to them that i was not that far behind they told me records don't lie. So i decided to call the next day because they were ready to close. I called that saturday from early morning to late afternoon imade about 8 to 10 phone calls, left several messages finally someone returned my call around 3pm new york time. I explained my situation and i was told that if i could come up with the necessary monies owed before the end of the month i would be able to get my car back. They told me to call j&m recovery and let them know when i planned on paying them. I called j&m on monday and explained to them i would have the monies owed before the alloted 10 day period which was the 15th of feb. I called americredit several times from feb5th on to the 9th to tell them once i got my tax money i would pay.
During that time i was given the run around calling several times each and every night for and entire week. Each and every time i would leave numerous messages and each time only getting a call backonce. I called about every hour on the hour from feb 5th to the 9th. Finally i got the tax money that saturday the 10th i called americredit i spoke to a women named susan who told me that know that i have the monies due i was to get what they call a western union quick collect form she gave me the infonecessary to fillout on the form. So i proceeded to call j&mrecovery i told them i had themoney and when can i pick upmy car. A gentleman by the name of jose answered the phone i gave him the vin number and proceeded to tell me my car was already shipped out to and auto auction in new jersey. I was irate he told me that the car was shipped out by orders of americredit. I called the localoffice in texas they told me i got the wrong info and if i wanted my car back i would have to go to jersey and the name of the person i needed to talk towas a debbie carbone. Iwas given her cell number i called three times she never once returned my calls. I aclled americredit back and told them in a voice mail message either you get my car back or you keepit. I got a call back that monday they told me it was my responsibility to get the car back.
I never bothered calling back because because i knew i would never get the car back. Several months later on april 27th i received a letter stating my car was sold at and auction they received 9400 dollars and toldme i owed 3,400 dollars these were the supposed fees for towing, auction charges and a remaining late fees. They called me at work i told them the amount was charged off to the 3 credit agencies. I never heard from then again until this past week they harassed me and threatened to garnishmy pay check also they violated the fair credit law by calling my job and also a mr kareem taylor from asset acquisitions as much as harassed me and told me you don't pay your paycheck will be garnished. My monthly payments were 413 per month for 72 months i payed 413 for 42 months which comes out to 17,346 americredit received 9400 at a car auction in jersey which put the amount at 26,746..
I spoke to a mr traylor who explained tome that i owed over 10,000 on the remaining loan and even though they got 9400 the remaining fees i have topay stem from towing, auction fees which come to 3,400. I think that's wrong americredit is getting more than what the car is worth which was 18,621. I am being forced to pay for something that already been paid for theamount shown above is what i had to pay on the loan this is not fair paying for something that i shouldnt have to because i was lied to.
