I was involved in a serious freeway accident on this past Sept 5th. I was in the third lane when a dark vehicle cut into my lane and my SUV clipped him on the right rear side causing my vehicle to go into a vicious spin. I spun across the fast lane and hit the center divide head on. My speed at this time caused me to spin around again and hit the center divide again. Shortly after as I was loaded into the ambulance the CHP officer began to question me on how I remember what had happened. I was suffering at the time from severe shock and severe chest contusions. So I really don't remember anything I told this officer and I would swear that under oath.
He then proceeded to write his report on my version at the time I should never have given him one because of the shock and pain I was in. Based on this report they found me negligent and responsible for the accident. My question to them was, " Is this their normal procedure for taking a report?" and their seargent said yes; and we have enough experience to know if you were in proper condition to be questioned. I said, " So your officers are doctors too!?" He got very upset and told me they were standing behind this officer-But what else can you expect; they always protect their own.
Based solely on this report my insurance are taking responsibility for me causing the accident. When I asked what does tis mean to me ; I was told my premiums would double. My biggest question is this"How they base complete blame on the answers I gave when in no condition to give them? I want to appeal but have been told It would be senseless to do so by the CHP and Farmers insurance.
On top of everything else CHP wants 10 dollars for a copy of a bogus report. Shouldn't the injured party (Physically and wrongly) be allowed access to it for free. I'm being screwed everywhere I look. What is your opinion?
