It all begin in 2007 when my husband lost his job and I was 7 months pregnant with our scond child. We fell behind on our mortgage payments 1 month but when we sent it the next month they refused to take it calling it a partial payment. It just got worse from there with no work and being unable to pick up a second job due to being pregnant, we were told by various loss mitigation associates that we would be set up on a loan modification, three payments and then a huge lump sum, once you pay the three payments we would be "considered" for the loan modification.
It was not only scary but highly unlikey they would work with us to re-structure the loan so that we could afford the payments. Being under the gun, we filed Chapter 7 to help us get a handle on our finances and to stop the foreclosure from taking place. It continued on into where we encountered more promises from loss mit. At one point we started into a special forbearance with the agreement of documentation to secure our loan into fixed rate.
On 7 seperate occasions we called to obtain such paperwork only to be told it had been sent out already.in March 07 with no guarentee, we made a decision to not make the next payment, the money was kept and the agreement broke. It this point we were starting to believe that all they wanted was the money and were really not going to help us with modifying our loan.
All along we have filed compliants with the AG, OCC, and local Senator to try and help us stay in our home. We have two small children who enjoy their friends and school. It is going to break my eight year olds heart to have to move. We have now after all this time been "DENIED" any loan mod. With Wells.
After all this time sending our finances in 4 seperate times over 50 phone calls, getting help from HOPE NOW, CCS, Senators, Lawyers etc... She told us "unfortunately you do not make enough money to stay in your home"??? What??? Why were we approved for the loan mod. Before??? NO ANSwer!!!
It is with a heavy heart that in a few months I will have to leave my American Dream, pick up and go foward. People please keep your money, unless they give you a guarented letter stating the terms of your loan. UNethical, Unlawful practices!!! All they wanted was money, not to help us stay in our home, they do not care!!!
