We are devistated, but not surprised to read Annie's posting.
As owners of a troubled condo in the Washington Heights, we entered into an agreement with Howard a few years ago. He represented us as well as a number of other owners in a case that he said was a "no-brainer" and an "easy one."
We raised not only funds from other owners, but also their hopes, in an effort to rectify a long period of alleged financial wrongdoing by the building's "sponsors".in a door to door effort, we raised $25,000, which we turned over to Howard as his up-front fee. Those who contributed were very hard working people, many of whom were immigrants.
One of the contributors, Nick had fought this battle with the "sponsors" for over 15 years. This gentleman was terminally ill with cancer at the time Howard was representing us. This man put his life long hopes of solving this case into Howard's hands. We believe Howard acted without conscience or commitment to those who placed their trust in him.
The case was dismissed, because it was filed improperly by Attorney Blau. The judge stated in her ruling that while the evidence was clearly in our favor, she had to throw out the case on a technicality.
There was an uncomfortable air in the building after the judge's ruling, and we feard for the safety of our family. My wife was pregnant with our second child, and we were directly and indirectly threatened by persons in the building who were allied with the "sponsors". We subsequently sold our apartment and moved almost immediately after.
After numerous unanswered calls to his office, Howard promised us that he would refile. He never did.
After we were made aware of the move to disbar him by the NYS Disciplinary Committee, we also filed a complaint with that office. Since it was a civil case, we have been referred to another office, and are awaiting additional forms to file.
What is most disturbing is that the man flaunted his "honesty" and "friendship". He also bragged about all the wonderful vacations he took, his beautiful apartment, the vespa scooter, and other seemingly expensive luxuries that we and those who contributed toward his up-front fee could not even come close to afford.
He must be stopped. If we had the resources, we'd sue him purely on principle. Our previous experience with litigation was extremely unpleasant, however I think we could stomach it if we knew he'd get locked up.
This guy gives lawyers a bad name. They are not all bad, but gee wiz - Howie really does it up in rare fashion.
We hope that in memory of Nick, a friend to all who lived in that building, justice will be served on Howard Blau.
