False Advertisement on Dog Park

In January of my husband and I decided that we wanted to move to the Downtown/Uptown area. I had just received a job offer for a company on McKinney Avenue and figured this would make my commute much more bearable. Originally, we avoided looking downtown because we own 2 large dogs and did not want to hassle with having to find areas to walk them. After a couple weeks of looking we came across a new development downtown that advertised a private dog park along, rooftop pool/theater, and many other great amenities. My husband and I were very excited and decided to look into the Mosaic.

At this point the building was a few months shy of being ready for occupancy so we pushed back our move in until March. When we signed our lease in March we were once again assured that both the pool and dog park would be complete by May. As May approached we were curious as to the progress of all these promised amenities. Each month we were told that they would be complete at the end of the following month. Finally, on October 31 they had the grand opening for the pool, but where was the dog park? This was a complaint made by several residents.

After many complaints, they put down a 9x12 foot piece of astroturf between the Mosaic and TXU buildings. They put this down despite knowing it was a violation of city code. First, it was on public property. Second, there is no way this could have passed any health codes. It remained there from November until two days ago when the city asked the Mosaic to remove it. I am not upset with the city for removing it as I never used the area and Mosaic management knew it was illegal.

I have tried speaking with both the property management and owners about our "promised" dog park with no success. When I asked management what they were doing to resolve the situation they said they had updated the website and brochures to no longer show the property as having a "private dog park". This is great for future residents, but this doesn't help the large population that already lives here and are locked into lease obligations.

What has appalled so many residents and myself is that the Mosaic used false advertising to get many pet lovers into an apartment that they otherwise would not have considered. Many residents are forced to let their dogs use the bathroom in the parking garage as they do not feel comfortable walking their dogs at odd hours in the evening or morning.

I really feel that the public needs to be educated on the false claims that many apartments make in order to get you to sign leases. With so many new properties being developed in the Downtown/Uptown area I would hate to see someone sign a mortgage on a property like ours and then not be able to sell the property for what they paid because promised amenities never came to fruition.
