The Apartments, The Dermot Realty Management Company, Wakefield & Associates Failed to perform repairs and then Ripped off when I moved out

Aventine apartments were recommended to by a family member, however he lived there 10 prior to me. When he lived there it was considered one of the better apartments in the Denver/Aurora area. At the time I moved it cost twice per month as much as it's neighboring apartments. On my first visit I was shown a unit that had kitchen with new appliances and was spotlessly clean. I waited and visited a few other Apartments before deciding on Aventine despite their much higher rates.

I was told I had to sign a lease then if I wanted them to hold the Apt for me, the apartment was still being cleaned and renovated so I couldn't view it. I signed the lease without ever viewing the place, I was told all of the units had been recently renovated and mine would look just like the one I was shown (that had been renovated).

A few weeks later I moved in on a Saturday when the office was open but only had one employee. She told me because she was the only one in the office she couldn't leave and view the apt with me and handed me the keys. The moving truck was waiting outside with my belongings and I didn't have time to wait around with my friends and family there to help me move.

The appliances and kitchen were all original from when the building was constructed in the 70's. Not at all like the unit I was shown. The unit was on the 6th floor and had two balconies, one for the living room and one for the master bedroom. The living room balcony (the only one I ever used) was in major disrepair. Large chunks of the stucko for the living room balcony were missing or falling off, the balcony was littered with the chunks that had fallen off. The outdoor on the balcony had at least two inches of bird dropping built up on top, the wall below the light was covered in with it also.

I contacted the management after moving in about the bird droppings. Sometime later after me checking daily when/if someone was ever coming, they came and cleaned off the lighting.in the process of cleaning off the wall they pretty much just smeared it around and then left what had fallen off on my balcony. The wall, I was told was to much of a repair to do during the winter and I would have to wait until the weather improved before I could put in another work order for it.

Shortly after moving in I realized the refrigerator compressor ran nearly constantly as was so loud it would prevent me from sleeping at night. A few weeks after turning it a work order I was told, its an old refrigerator and I should expect it to be noisy and run nearly continuously. I asked them if they would like to pay my electric bill for my refrigerator, only malfunctioning wasteful units ran continuously. And the unit I was shown before I moved I was told they would send out someone to check the seal on the door to see if that was the problem.

Again I was told it was an old unit and I should expect it to be noisy and run continuously. Several work orders later and some convincing they replaced the refrigerator with a another unit that was only 15 years or so I'd have to guess, they acted like they'd done me some HUGE favor by doing this.

A short time later I realized that by using my filter fan (its not a real vent) in the master bathroom the other bathroom would completely loose power. I informed the office staff of this and they opened a work order. A week later I stopped by to see why they hadn't looked at the problem yet. They had no record of the work order and would open another one. A week later I came by to see why they hadn't fixed the problem yet, again they had no record of any work order and they would create one.

This time I asked for a copy of the work order, I was told they didn't have copies and they could print out anything that resembled a work order. So I told them I wanted a hand written work order as proof I had been in the office and requested it. I was told they couldn't do that without their managers permission and the manger was not it.

Eventually someone did come out to my apt and look at the problem. It was a weekend and I was there, he spent about an hour troubleshooting. He then told me the problem was in the walls and could not be fixed, there was nothing he could do. I have this in writing on a copy of the workorder.

At that point I was completely fed up with the Apts and the staff. I contacted the regional Manager and set an appointment with her. At that time I told her all of the problems I was having the actions of the completely incompetent staff. At the time of the appointment I had a crisis at work at was forced to return. She at that time assured me the problems would get taken care of and I needed to resubmit work orders the problems.

At that point if the staff had not refused to give me copies of the work orders I'd have a stack of them. I wasn't going to put in more work orders when they were just going to refuse to give me a copy of them, and then have them suddenly disappear again.

I began looking for a new place to live and found one, with 30 days notice I moved out 22 days early on my 6 month lease. Stating on the thirty day notice my reason for leaving was repairs not completed and work orders ignored.

3 months later I got a bill in the mail for $2100.00 dollars for leaving 22 days early on my 6 month lease. The rent for the apartment was $870. They are charging me almost 2 months rent for leaving 2/3's of a month early after they failed to do anything for me but lies and collecting my rent.

Colorado has no clear laws on renters rights and I dont know what I can do.
