Predatory Deceptive Entrapment Dishonest Ripoff

Three Months ago, I got a phone call in the middle of the afternoon, from someone saying that because I was such a good VISA cardmember, they were offering me a free $1000 Internet shopping spree. Naturally, I thought that was a load of crap, because I do not even have a credit card, only Visa debit.

The man on the phone proceeds to tell me that I can have this $1000, just for signing up for some magazine subscriptions. I thought, whats the harm, If I order the magazines, I can cancel if I'm not happy, right?

WRONG! This company uses your conversation as a "verbal agreement" & refuses to refund your money. Three days after the initial call, I got another call from America's Choice, "confirming" my order. I had changed my mind, & asked for a refund.

I was told that they did not give refunds or accept any returns. I asked how they could take my $39.87 initial payment & give me nothing in return. They assured me that I would recieve 2 years worth of the magazine of my choice for my money, & they would cancel the rest of my "subscription". The man on the phone asked me what kind of magazines I like, and I said Conde Nast Traveler, Travel & Leisure, or Carribbean Travel & Life. Note the theme here. Travel magazines.

It is now 3 months later, & after recieving a random Interview Magazine in the mail, I start to wonder where my travel magazine is.

So today, I decide to call America's Choice to find out what is going on. The man on the phone says I ordered Interview magazine, & I cannot change my selection because I cancelled the service & therefore they have nothing to do with my magazine choice anymore. He also tells me that I must have ordered Interview or agreed to it.

I explain to the man, that I never read Interview, Never buy it, I have no interest in celebrity lives & would not have agreed to that magazine choice.in a nutshell, he tells me that indeed I did! And that since I was no longer recieving their service, (due to the fact that the extent of their involvement is taking my money & placing the order), my complaint couldn't be about them.

I assured him, that I was complaining about them, since they took my money & they were the ones who placed an order for a magazine I do not want! He tells me, sorry there is nothing I can do.

At that point I told him I would make a complaint with the Better Business Bureau, & that I believed what they were doing wasn't legal. He tells me they are a Federally Controlled Company (Reeeaaaaaallly!!??) & offers me a 3 day 2 night voucher for a Motel in Vegas.

I refused that ridiculous offer & said that what I really wanted was a different magazine! Of course, the company that can take my money & make arrangements as to what to do with it without my consent, is powerless to change my magazine selection to the one I had originally requested.

The man from America's Choice then offers me a $60.00 Gas Voucher. I told him I would accept it, but if I did not recieve it I would go to any agency I could think of to call attention to their scam.

I honestly do not expect to recieve any voucher, & if I do I doubt that it will be without a catch. This Company is deceptive from the start. I cannot see how something you are duped into can constitute a legally binding agreement.
