I joined USA Fitness Centers in Lewisville, Tx in 2003.in 3 years of membership I never missed a payment and even renewed my contract after the 1st year for 2 additional years. At the end of those 2 years is when the problem began.

April my contract ended and I spoke with NFS Financial who is who does the billing for USA Fitness Cetners and Matrix Acceptance. All 3 companies are tied together so it is more than difficult to get straight answers and impossible to talk with the same person twice in a row.in April I confirmed verbally with NFS/USA/Matrix that I would NOT be renewing any additional years on my contract. They claimed that even though my contract was up at the time we spoke on the phone I would have to send in a written notice. I took down the address and sent them a printed letter I made that day on my computer to confirm in writing I would not be renewing another term.

They then continued to draft my bank account for May, June, July, August and a club maintenance fee in August even though I protested. I contacted them in July and August when I noticed the drafts were continuing and they claimed they did not receive a written letter to them. They also informed me even though I had verbally told them not to draft my account any further they would not cancel the draft and would not refund my money.

At that point I took it up with my bank and even after disputing it with the bank they could not show a binding contract that claimed I must go to 30 day billing after the end of my contract. I was only asking for the months back of June/July/August and they still have not given back anything other than what has been charged back. The additional months will have to be charged back through my bank as Matrix has entered into the scenario at this point.

According to them I did not have the right to charge back money that was stolen from my account.in addition to the $100ish that was charged back they claim I owe them almost $300 now and they are going to report on my credit report. Being that they are a 3rd party debt collector I know they cannot legally do that so I am going to file against them in small claims court here in Tx. They seem to think they can choose any amount of money they want and attempt to blackmail you into paying them even when you do not have a contract that is valid.
