My wife makes home made chocolate candy, which she sold on consignment at the Hampton Inn in Buckhannon, WV. When the franchse was acquired by the current owners, they started slow paying her (even though it was consignment, and they only paid after products were sold).
Finally, they stopped paying altogether. She delivered candy in January, and they sold several hundred dollars worth.By September, they still had not paid.
We finally filed a Magistrate's claim, which they did not contest, but they still refused to pay. They eventually offered us the $736.84 they owed us for product sold, but refused to pay the $105 court costs.
We obtained a judgment, and forced them to pay. But they wiggled out of interest, etc.
They are such deadbeats that we were just happy to get the invoices paid and the court costs (filing fees) reimbursed.
Rumor has it that the franchise owner is an LLC from New Jersey owned by a bunch of foreign doctors, but that is unconfirmed.
