I moved into my apt 7 weeks ago and for the first 4 weeks my neighbors harassed me with loud music, (some vulgar) (would start after 11 PM) cigarette smoke coming in my windows (summer it's hot and no air) slamming doors, people running up and down the stairs, screaming, drinking beet on my front porch, beating on my front door, spitting on my porch, and attempts of intimidation. (After midnight)
I called the police 8 times and basically they did little. (They told me I needed to move) I called the management company, went to the managment company in person, and sent letters as e-mails.
They told me they would find me another apt and give me back my deposit but they did none of this and served me with a 30 day notice in the middle of the month after I had only been here for 2 weeks. Retaliation for complaing! (They did nothing to the neigbors)
I told them I could not get out so fast as it was very expensive for moving/relocation and they had my $1000.00 deposit. They ignored me. So July 2, I paid the rent in full and it was accepted until two days later they said they were sending check back to me certified mail. 26 days later I have not received the check back!
Interim I filed small claims for allowing them to let my neighbors be a nusiance and for prop 65 and the Bane & Ralph Act.
I am an older white female and they are very young and two are gay. I have many gay friends and no way am I homophobic!
I was disallow any normalcy or my rights to have a reasonable, quiet environment or peaceful living. I have suffered from fear, and sleep deprivation and the opportunity to go back to work.
I am disabled and can work part time!
Interim they served me with a 3 day notice to pay half the rent or get out and I ignored because they refused to return the $800.00 check.
They would serve me with some type of notice on always on fridays.
I went to small claims court and lost because the Judge was irritated because of their 3 witness and my one and he stated we were only allowed 5 minutes. (One witness of Pabst, Kinney was a receptionist who is a nasty, hateful individual) She told the Judge I called their offices and used vulgar language which is untrue as I do not do phone calls but e-mails to cover my behind! I was not allow to explain as much as I am presently writing!
The agent from Pabst, Kinney C. Gomez lied about almost everything she was asked; and I was not quick enough and or disallowed by the Judge to respond or say "that is not true or that is incorrect. I have filed for an appeal in Superior court!
Maybe I will be allowed to tell it like it is in Superior court?

Today they had me formally served with an eviction notice while they hold a $1000.00. I have broken windows, roaches, and was harassed by the neighbors and now I am a victim of retaliation.
My friends and a few neighbors do not believe what has happed and one neighbor who was going to assist is scared of this managment company that maybe they will retaliate against them.
I have been in this apt less than two months and I am packing in between writing this. I have been screwed badly by this scummy company as movers, trucks and my time have cost big time not to mention filing and serving fees.
I am glad to leave this rat hole as I thought it would be okay for the summer to be by the beach. Wrong!
Now I have to answer an eviction notice while they hold an $800 dollar check and a $1000.00 deposit and it is insult to injury.
(My credit could be ruined)
Last week I did finally put a "stop payment" on check!
They then stated I could stay (lease extention) if I gave them the money in a cashier's check! I do not write bad checks nor have I ever!
It is all a game like something out of a bad movie and the agent herself came over here and blasted music from her truck in front of my apt. Of course she denyed this!
I am bewildered that a company in 2006 could get away with all this and not keep their word and lie to a judge and keep the harassment up. Pabst, Kinney & Ass. Does have a very poor reputation in Long Beach and Lakewood, CA as you will hear complaints from many people as attorney's. It seems that when Pabst, Kinney Management Company is wrong they think they are right regardless!
