Labbb warning! Do not arbitrate through the better business bureau
We have information on the LABBB that PROVES they are in collusion and acting fraudulently and unethically in their arbitration process. We have just finished compiling the case for submission to our Congressman as well as the County District Attorney. We will also be submitting to 20/20 as well as other programs that may be interested in the magnitude of the LABBB malfeasance. Because what we have found is so overwhelming, it causes us great concern.
We do not mean to malign any other franchise of the Better Business Bureau, nor are we stating that some people in the Better Business Bureau do not have good intentions. Some of the bad apples are right at the very top! The information that we have uncovered has been strictly involving the Better Business Bureau in Colton.
In researching the Better Business Bureau, we came upon numerous sites with claims against the LABBB and of lawsuits. Unfortunately, many were by somewhat disreputable firms as well. That is not the case here, and that is why one can be hopeful that the information uncovered will be taken seriously. We are concerned about the individual American that has and will continue to be harmed by this Kangaroo Court, that is called the LABBB arbitration hearing.
You may not be aware that arbitration hearings through the LABBB do not have to follow any rule of law, yet the award can be confirmed through our courts as if it were adjudicated. The arbitrators are chosen by the LABBB, are trained from the LABBB, personally know directors of the LABBB, yet the consumer is suppose to think they will receive a fair hearing. Scary! Further, when the arbitration hearing doesn't follow any of their own rules, it will be up to the individual to attempt to vacate the award when it goes against them. 75% of the awards go in favor of LABBB member businesses.
If a company uses the LABBB arbitration clause in its contract, that alone should give you pause, especially if the business has other avenues of arbitration available to it. Contractors should use their State Contractors License Board. Other licensed businesses often have arbitration through their own agencies. NEVER agree to a contract with a Better Business Bureau arbitration clause. Go to court instead, where there is judicial review for error, discovery, etc. Don't give up your rights. Question the legitimacy of contractors using this clause.
I will close by stating that everything you need to find out about the LABBB is contained somewhere in public records. For those of you who think you are dealing with a corrupt business who is a member of the LABBB, check out the LABBB website, go to "arbitration hearing reports", and download the report.
HINT: Notice any of their members that have more than one hearing? Watch out! That is your clue to finding the corruption, all on your own.
HINT: Board of Directors are responsible for approving membership applications, should they be arbitrators as well?
HINT: Should the President make 3x's the compensation to that of comparable CEO's of non-profits?
