Judge James M. York, also known as Jim York, unfairly judged me during a custody battle. My exgirlfriend has had 8 places of residence in 2 years, 5 boyfriends, 10 jobs, and is neglectful to my 5 year old daughter. I had her friends, her mother and sister, and 3 years worth of proof. Even CPS letter finding her guilty of neglect for leaving her home alone. Even a ticket from a police officer for leaving her in the can at the grocery store when she was 1. Counselor results from my daughter's older sister (8 years) that shows the counselor strongly suggests NO CONTACT with the mother, because of all the mental abuse she has caused. Pictures of my child dirty, sick, and poorly cared for. Pictures of her with 20 ringworms all over her body for letting her bathe with a cat at her house. All this and I still lost in court during a temp hearing.
My daughter was appointed a lawyer, and that lawyer even thought that she needed to be living with my wife and I. My wife has been in my daughters life since she was 11 months old, and she is more motherly to her than her own mother.
The judge made a comment the all children should be with their mothers, right before the hearing took place! He let her and her lawyer make accusations without interruptions, but forbid our side to do the same. The judge even denied my daughter's mother's diary to be admitted, in which she wrote that it wouldnt bother her if something terrible were to happen to her 8 year old cause she discusts her and makes her sick when her daughter kisses on her. I have lots and lots more, and all she had on me was one assault between me and my wife when we were dating. All I did then was just push her. So her lawyer and her had the court believing Im this violent person that beats my wife. They even went as far to make up other violent events by me. Said that I beat my mother, who has been deceased since I was 17 from cancer. I cant believe her lawyer just made it up! It really hurts bad, to know that you do everything to help your child, while someone else uses her to self gain and cares less about her well being.
My hands are tied in the courtroom, and I am getting desperate.
Now after court she has no job, AGAIN! And is trying to survive off of my child support alone wich went up to over 800 a month. Now sleeping over at some new mans house she just met, and my daughter tells me that her mother begs her everyday so they may stay with this man. My daughter also says she has been peeing in bed over there. She says she can never go home anymore.
May God help her, and help me get through all this... I am on the verge of loosing sanity because I have no way of helping my daughter.
And by the way, the judge will not recuse himself.
