We moved into our newly constructed home in Ashton Park, Franklin, TENNESSEE in Oct. 2003. It was built by Main Street Homes, which is an arm of Park Trust Development (Bob Parks). The Pres of the company at the time was Randy Chastain. Our lot was developed and the home was built under Randy's tenure.

There were geo-technical engineering inspections/reports done on the lots in Ashton Park; the land is extremely rocky in this development. We paid $7500 extra for our lot, considered "Premium".

Unknown to us until recently, there were 5 lots noted in the geo-tech report which had large boulders 1-3 feet in diameter, which apparently were covered over with gravel and dirt, rather than being removed or broken up. Our lot was in the middle. The report was never disclosed to us by the builder.

Our home has growing cracks in the back foundation walls, just one of many, many problems we have experienced. We hired a structural engineer who found defeciencies and construction not to code, as has the City of Franklin.

Main Street's solution to the cracking and further movement of the house is to put jacks on the back end. The builder recently had 22 jacks put under the Have you tried selling your house under these conditions???

The home next door to ours was involved in an 18mo legal suit with Main Street Homes, before the builder settled and bought our neighbors out. It is one of the 5 lots aforementioned. The house literally cracked up with the back of the house (Master BR and BA included) falling inches below the rest of the house, walls splitting apart, cracked ceilings, and hardwood splitting apart. AFter Main Street took possession of this house, 22 jacks were placed under it.

Additionally, last October the builder removed kitchen walls around 7 windows due to severe leakage, as well as a 3' wide area of hardwood floor, leaving the slab exposed. We have lived in a state of re-construction and repairs, with problems in the house ever since we moved into it.

We have had to hire a lawyer to file a lawsuit, as the builder refused to respond to our request to buy us out, as no one else will give us the value of our home. We only wish we had the deep pockets of Bob Parks & Main Street homes to pay the steep legal expenses, to get out of this nightmare.
