This complaint I'm making is against Heber Toala (David Gomez). I am posting this so everyone knows the new business name he goes by, which is Allstates Remodeling. The old company name was PSR Restorations which was based in Dallas. PSR has an F on the BBB, which is probably why he changed his business name and has since moved to Houston. His website is allstatesremodeling.com and if you take a look on there, there is NO physical address to his business in Houston. His name is also not on the website, but IS on their business card along with Kony Huerta, the manager for the Houston location. The following is my experiences with Heber Toala and his business antics:
During 1st week of July, I was entering my house and 2 people approached me from what looked like a construction company truck. 1 male, named PABLO (PAUL) ROMAN (RAMON), he had a clip board with contracts, & an Asian lady, named Meg. He mentioned my damaged roof & I told him, "I know we need it repaired, we just don't have the money right now." He then proceeded to tell me about his company. He stated that they specialized in roof repair, that they would deal with the insurance company for me, & if the insurance company approved the claim, they would ALSO pay my deductible as long as we contracted them to complete the work. I thought, "Wow, win-win." I told them that it's my monther-in-law's house, I just rent it, but if they gave me their info, I would let her know and get back with them at a later date. He said he ran out of cards, but he had a contract which he gave me. Later on I was reading it and realized, that it said we WOULD have to pay the deductible, so I called the number on the contract, and the manager, HEBER TOALA, answered. I expressed my concern over the deductible and he said that they had to put that into the contract, but through their referral program, we would get our deductible paid for and never have to come out of pocket with any money. He said he would write it into the contract when he came to the house to finalize the roof repairs. I said ok and I talked to my mother, she read the contract, and decided that we would go ahead with it. She signed, & I called them back. Pablo came by our house & picked up the contract 15 July, w/o leaving me a copy. I called him to tell him to come back with my copy and he said not to worry, he would be by the same week to inspect the roof and he would give me the contract then. When they came by 17 July, Pablo inspected the roof & the Asian lady came in the house with me to open up the claim with the insurance company. I gave her the policy # & the insurance adjusters information. Pablo said that he would be the one to meet with the adjuster. Everything seemed fine to me, & my mother got the insurance check for $5185.69 in the mail about 1 1/2 weeks later. I called Heber to let him know. We set an appt. To meet at my house 1 Aug to finalize the contract for work. He said to make sure my mother was there with the ins. Check, that he needed the check to start the work. After the work was complete, then they would send proof to the ins comp and the ins comp would send the remaining cost for the repair work, which was $15,012. He also reassured us that our deductible would be taken care of. (I didn't get him to put it into the contract!!! : () We picked out the shingles, and they were to start construction on 10 August.instead, I got a call from Heber on 5 Aug telling me that the ins comp would NOT pay the remaining payment because of the type of policy that we had, & that he felt bad, but we would have to pay the remaining cost. He said he talked to his boss, and got them to lower the cost, so we would have to come out of pocket $12 grand instead of the $15 grand. I got upset with him and told him that he lied to me, that we don't have that kind of money! He apologized some more and said there was another option. He had proof that our roof was build in 2002 and if he submitted that proof to the ins comp, that they would pay an additional $8000 and we would only have to pay them $4000 out of pocket. If not, we could cancel, but there was a cancellation fee of $5200, the amount of the check we gave him! I told him I didn't want to cancel, I wanted them to patch up my roof with the $5200 that we gave him, but he said "No, because it would cause more damage, to just patch up, we needed a total roof repair. At this point I knew it was a scam. I told him to submit proof so he knows I'm not cancelling, but whatever proof he's submitting is fraud because I talked to my mom and she says there is no way it was built in 2002. I told the ins comp, made a police report, and I am also going to be taking him to court.
