I am a Commercial Loan broker. Contacted Alan Gibbons and spoke with him about funding a client for a potential loan. Sent in all requirements, several meetings. Was assured that the this deal could be done by First National Partners. Client pays all fees required by First National Partners. On the final day that the commitment was supposed to be issued, and only after a telephone call from me, Mr Gibbons sends over a loan offer WITH NOTHING that was previously discussed. I thought there was some mistake. Then he states, "the loan couldn't be funded on the program that we discussed. It has to go to another source."
CLEARLY THIS WAS BAIT AND SWTICH. Then client requests a refund. Refund was promised. 1st week, has to wait for the refund to be processed. 2nd week same excuse. 3rd week, supposedly the refund is processed, and he will send it out as soon as his corporate office in Hong Kong deposits the funds. 4th week, still no refund. After a month and a half, I have to call from a different number, because Mr. Gibbons avoids calls. I finally catch him and he states that corporate DID NOT ISSUE ANY REFUND AT ALL. Thus this client paid money for NO REASON AT ALL. Not so much as an appraisal ordered.
I have copies of the wire transfer showing when the wire was sent. All e-mails pertaining to the transaction. And phone records.
