We received a call from this company today. Well, it was an automated call to begin with from someone saying that they were contacting us regarding a legal matter and that a case would be filed within 24 hours against me unless I called the number they provided: 855-393-3793. When I called the number they spoke quickly and I believe intentionally slurred or spoke with little articulation to confuse or attempt to confuse. I asked each person I spoke with to repeat or clarify comments several times. I believe they purchased old debt from another collection group. I did have a credit card with the bank they mentioned - however, I worked to negotiate a payment plan following a loss of employment. September is the date they gave me saying "you signed a contract that allows collection for 12 years from the time you stop making payments". I asked for a copy of that information and they said "you'll get it when you have to appear in court because we are going to sue you". They also claimed to have "proof that they mailed me information about this matter over the past several years". I said I didn't recall receiving anything that was certified from their company or from the bank where I had the credit card. He said the postmaster in your town will personally deliver the information into the hands of your presiding judge. They also said, they couldn't provide this information to me but I would receive when I had to appear in court.
I could go on, because we spoke for a long time, however, the result is that they wanted to "collect the balance that was due" and "if I could pay either right now or within 24 hours, they would not charge the interest or added fees and of course, there would be no related legal fees" ($2500 was the amount quoted) and after only a little negotiation, I could pay with my credit card and they would reduce the amount due by "maybe $1000". The person I spoke to said I would have to call back within 24 hours to get the deal. I asked for a letter outlining the offer to pay the balance and forgiving the other fees and interest.initially, he said he can't do that; so I said, oh, it's about the timeline, well, you can either fax or email it to me. He ultimately said he would fax it. He gave me a web site url so I "can check my credit report and see all the information from the bank". At least twice he rattled off a list of 'crimes' related to the complaint to be filed in my "local judicial district" and the subsequent penalties in addition to the financial awards to the company, I would have "a record" and I would be held in contempt if I didn't pay them after the judgement. He said that would mean I would need to appear in court again and it might cost me even more. I'm going to contact an attorney to see what my best tact will be.
