Please allow me to introduce myself. My name is Vonda Williams. I am the office manager for Ron’s Roofing Inc. Recently, we had a big surprise-and I thought I would share this with you to see if there was anything you could do to help us with this situation.

We have trash Service with Deffenbaugh Industries PO Box 3220 Shawnee, KS 66203 913-268-9813. We had a tenant in our building that had a container on site-and when they moved in we contacted Deffenbaugh to continue with the trash removal service for our office building. On 6-27-07 we signed a contract with them. The sales rep did not leave us a copy-so on 8-22-07 they FINALLY faxed a copy of the contract we signed to us-after many calls asking for a copy.

During that time to now-we have had issues with the driver and their poor service. He became angry when the trash was not loaded to suit him-he got out of the truck yelling at our employee-threatening physical harm to him-when I heard about this incident-I wanted to call them and cancel service-but Ron Williams-the President of our firm-said to let it go-that the guy probably was having a bad day. During that time to present-this driver has came into my office yelling at me because the gates were not unlocked numerous times-so I gave him a key in order to get this yelling person out of my office and face as quickly as possible. This guy was a NUT!!!

On 1-31-13-our trash was scheduled to be picked up. The driver never came. Ron had went out at 7;10 A.M. To open the gates for the driver (I know what time it was because we discussed him coming and I did not want him in here yelling at me again) so Ron opened the gates that day. The driver never came. We called Deffenbaugh about why we were skipped-and we were told the gates were locked-which I told them was a lie-because of the situation that occurred prior to the gates being unlocked for him to come pick up. I told them that due to the service we had been receiving, (our service was sub standard-trash dropped all over the ground, lieing about picking up our trash, yelling at our employees, just the whole situation with this company was getting to be worse and worse. So I told them when I called in to cancel our service. They price was almost TWICE as much as the other local companies-their service was not good-and we were ready to part ways with them.

The lady said she would have someone call me back. I was indeed called back by Lindsey Lambing-I told her my issues (did not tell her about the driver because times are tough-I did not want anyone to lose their job-we just want away from these folks). And on top of the poor service-their bill was almost TWICE as much as everyone elses. First she said she would match the other prices-then I told her no - we just want to part ways. Then she told me we had a 5 year contract with them-and it had just renewed for another five yearsw-and I could not get out of it. I asked her to fax a copy to me-because I did not remember signing a contract.

I did get a copy faxed-it was unreadable-but I did indeed sign it. It took 4 times asking for a READABLE copy to finally get one-What should I have expected? That is how their service I, also. Now I must say-I should have read the BACK OF THE PAGE-but I did not-I thought the terms I was agreeing to was on the front of the page-I wasn’t told about the back of the page-BUYER BEWARE!!! WOW-when I read the back of the page-it agrees to an automatic renewal after 5 years with a whole bunch of terms and conditions that are wayyyy out of line. They automatically renewed our contract with no notice for another five years-PLUS my price is TWICE as much as current prices for everyone else! So-what that means is by the time the second five year contract expires-my trash removal service can be anything they want to charge me! I project by then it will be 3-5 times more than the competitors of theirs! Holy cow! What a racket! Renew a contract at any price you want-and there is not getting out of it I am told by Lindsey-OTHER than signing a NEW contract that starts all over for another 5 years! Kinda seems like BLACKMAIL!!! I feel that we as consumers should have received some sort of notice of renewal so we could have the option to continue on or not. Now it is our fault for not reading it-but the salesman did NOT tell us about these terms and conditions-I was told we could cancel if we were not happy with their service! What a scam!!! Their contract states we can not have ANYONE else take debris from ANY LOCATION-they can charge whatever they feel like, if you do not notify them in writing sent certified letter to them not less than 60 days and not more than 180 before the contract expires-and a WHOLE LOT of other hoops to jump through, whistles to blow, and bells to ring-just to not renew service with these people! WHY can I not fire this firm for their crappy service?

Lindsey even went so far as to tell me I could not have other trash people anywhere on my property! WOW, I told her-she is pretty bold telling me who I can or cannot have on this property! WOW-The thing of it is-SHE MEANT IT!!! She and I did have heated words and e mails between us. NO ONE in this company was willing to compromise or try to resolve any issue related to this. It was pay your bill-what ever we bill you-and leave us alone-or we will sue you! WOW-GREAT PR SKILLS YOU FOLKS HAVE!!!

I got to speak finally to Bryant Wilkins-the manager-He was irritated with me from the second he got on the phone. First thing he asked me was did I notify the BBB about this matter-I told him I had and from that point on he was very rude, abrupt and hateful to me. I asked him if we could resolve this between us since we were on the phone right now-but he informed me he was not going to do anything for me to compromise in the matter at all-I was stuck with it and if I did not like it-too bad. I told him I have contacted the BBB, The Mo. Secretary of State, FTC, and every other agency that I can think of. And if I can come up with any others-I WILL!

The fact that this contract is all one sided-and also the crappy service and attitude of these people-WHO would want to do business with them? I feel that we were scammed-our salesman we signed up with - Mike Wilson did not tell us anything about a five year contract-we though we could cancel this service at will-as we should be able to for poor service-but according to them-they can basically do anything they want-and there is not a damned thing we can do about it.

So-we have a company that automatically renews your contract after five years with no notice-can raise the price to anything they want to-and there is NO WAY to protect yourself once you sign the contract. I feel like we were dupped by our salesman. What he told us and what is reality is 2 totally different things. And for this thing to auto renew with no notice is outrageous!!! We should be given the opportunity to separate from any firm that is sub standard in their service. But-according to them-we can’t! WOW-what a racket!!! You would think just for customer good will-they could have at the VERY LEAST-matched the competitions’ price quote for ½ of what I am getting charged-like Lindsey offered me in the beginning-but I made her and her boss mad-so they tell me the only changes that can be made to it is if we sign ANOTHER CONTRACT for another 5 years! Great customer service!!! And again-WHAT A RACKET!!!

I AM WRITING YOU THIS BECAUSE I AM ASKING FOR YOUR HELP-IF POSSIBLE. Also-I am asking you to let people know about this scam they are pulling on people. If it happened to us-Bet it is happening to you, too if you have service with them-you just do not know it!!! This is such a one sided contract-that it is absolutely AMAZING that they can get away with this! Again-stupid us for not reading it-I went by what Mike Wilson told us-BOY-did I make a mistake!!! Please look into this situation. I have been researching this on the internet-and I see LOTS of complaints on Deffenbaugh Industries-and am amazed that they can get away with this. A lie is a lie-and we were lied to-up front-and there are no repercussions for these folks for doing so. AND of course now that I am raising a stink-what do you want to bet my bill goes up AGAIN shortly AFTER they find out I am still complaining to anyone and everyone that will listen!

BUYER BEWARE AND READ EVERY WORD FRONT AND BACK! A very expensive lesson learned from doing business with an unscrupulous business! If you can give us any guidance or assistance in this unfortunate matter-please let me know! THANK YOU for your time and consideration! I am sending you a copy of the TERM AND CONDITIONS on the back page of their contract to see if you can see anything to help us. If nothing else-I hope we can stop this from happening to someone else!!! BUYER BEWARE!!!
