GC Promotion Dishonest

When I had my first interview with William Henry at Golden Cloud Promotions, he informed me that the position was 100% commission based. I told him that seeing how I had just left a position that was 100% commission based for health reasons, I was hesitant to work for commission only.

After a brief silence, he told me that he would pay me $300 per week or my commission, which ever was larger. He also offered me the position on the spot (something that he "has never done before." I started working for GC Promotions on October 22. I was told that there would be a 2 week delay before I would get paid (which is normal) and I would get paid every Monday from then on.

November 5 came up, and I asked for my paycheck. William told me that there were some issues and the client hadn't paid him for the sales that were done. He asked me if it were ok if he paid me the following week. I told him I understood that there were some issues on the clients part and I was fine with being paid the following week.

November12 came, so I asked William if I could get paid. Again, William gives me the same excuse. Irritated with the situation, I agreed that it was fine to wait yet another week. I approached William on Friday November 16 (23 days after my start date) telling him that I had plans for a friends birthday that week, and I needed to be paid. William gave me $300 cash.

November 21 William gave me $150 cash, then on November 26 he gave me another $150 cash and check for $300. I got a call from my family November 30, and had to go back to Kansas for some family health reasons. Over the time I was back home, I attempted to get a hold of William multiple times via email and calling the office.

He was very slow at responding to my emails and never answered the phone nor called back. I proceeded to contact the Department of Labor to see if there was anything I could do to get the money that is owed to me. I sent William an email informing him that I had contacted the department of labor with hopes he would start responding to my emails.

He responded immediately, with an email that said "you should send a copy of this also" and an attachment of the non-compete that I signed. Apparently I didn't read the whole agreement. Section 13 states "Distributor understands that HE/SHE is a self-employed individual/Independent contractor and not an agent or employee of the corporation. HE/SHE shall have no claims against corporation for wages, unemployment, workers compensation, or disability benefits."

While I was back home, I sent him an email double checking to make sure I could deposit the check, I wanted to make sure it didn't bounce. He decided to not answer, so I took the check to the bank the next afternoon. Later that night I received and email saying that the client took some of the money out of the account. Never once did the email say not to cash the check.

A couple of days later I looked at my account, and the check had bounced. I got back in town to Florida December 30. I drove up to Williams office Monday December 31 to talk to him face to face. William proceeded to tell me that I had been paid more than I should have (keep in mind I had been paid $600 total, and we agreed that I would be paid a minimum of $300/week. I worked there for 6 weeks. $300 x 6 weeks = $1800 - $600 that i had been paid = $1200 still owed to me.)

William then told me that seeing how I had signed the non-compete saying i can't go after him for any wages, that I had no chance getting any more money from him. While working for William, there were two other occasions that I know of where William either didn't pay what was supposed to be paid, or he wrote a check that bounced.

Anyone that is looking into going on an interview at Golden Cloud Promotions, beware!!!
