5 days before christmas order is cancelled by KB Toys

On 12/15/06 I purchased a toy from KB Toys Web site. I received a confirmation of the sale. This was a toy expected for Christmas. Today, 12/19/06 I received an email from the company canceling my order. The email states that the toy was backordered and the sale could not be fulfilled. However, at the time of the sale there was no indication anywhere on their site that the product was backordered. On the order confirmation it states that they cannot cancel the order. Here is the copy:

Dear C.: Thank you for ordering from KBtoys.com! Your order has been received, and we are processing it now. Once your order ships, you will receive a shipment notification via e-mail indicating the shipment date and the tracking number (if available). To better serve you, we offer a convenient online Order Status feature. Get the same, up-to-date order information our Customer Service Representatives use at kbtoys.com/s/orderStatus.html? FormNext=orderDetails&order_no=1822966&[email protected]&ls=default. Since we use automated order processing and warehouse systems, we can't cancel or modify your order now that you've submitted it. For more information about convenient returns and exchanges, please visit the link below. Kbtoys.com/help/return.html

I could buy it somewhere else and had it delivered for Christmas. Now, I don't have that option due to the proximity of the date or will cost me a fortune in shipping costs. The company has not offered any compensation or substitution for their misbehavior. I have never experience such disrespect to a customer as KB Toys has done to me and to the child that was to receive the toy. Here is a copy of the email:

Order # 1822966Items Canceled: 971869B - 27mhz Orange Nikko 1:16 Hummer Sut R/C Truck Dear C., Thank you for your shopping with KBtoys.com. Due to overwhelming demand, we have been forced to cancel the backordered items listed above. Despite our every effort, we cannot give an estimated date of availability nor keep it on backorder.

We want to assure you that the cancellation is not indicative of our normal level of service. We work hard to give our customers the best possible shopping experience and we regret taking this action. As a reminder, your credit card has not been charged for this cancelled backordered item, since we only charge your card when an item is shipped.

Again please accept our sincere apologies for any inconvenience this has caused. Sincerely, KBtoys.com Warehouse Services
