Sales And Service Ripped off for over 1/2 of husbands SSI for downpayment on spa never received! Indianapolis indiana

I found an ad for a spa on craigslist.org on aug 13th.
I called the # listed an spoke with Franklyn who said that he was moving and selling his hot tub, but it was a little more that I could afford. At that time he told me he had a hot tub business (Serenity Spas) and had a smaller hot tub that I could purchase. My husband is disabled and has had back surgery so I was looking for something to help with his pain. Franklyn had me call Gary who set up an appointment with me to see the tub.

We went on 8/16/08 and saw the hot tub. He explained that the heater needed to be replaced and he would do
that prior to delivery and make sure the spa ran correctly and it would be ready in one week.

I waited a week for the spa and Called and Called and Called and finally Gary answered after a week of calling, spa not ready. Spoke to franklyn about it, assured me it would be taken care of. Waited Called and Called some more, no answer. Wrote email to franklyn, who finally wrote back and assured me it would be taken care of if i just waited one more week.

HERE'S THE EMAL:
I am so sorry about all of this. We recently were a
victim of a check fraud scheme that has cost us thousands of dollars and created many angry customers like yourself. Your spa is still being worked on and like I told you over the phone, I'll know something by the weekend. If you would like a refund we will put a check in the mail, however, if you would like to wait for another week (by that time I'll have a bank account and will be able to purchase the final part to your spa) we'll complete your spa and all you will have to pay is whatever Gary charges you to deliver and install.in other words, I'm waiving the $250 due to the delays.
Again, I'm so sorry. I feel bad about your situation,
and it doesn't help that someone has taken advantage of
me and my company with a series of bad checks. Feel free to communicate via e-mail. I wish you and your husband all the best.

So here it is another week, and i'm calling and calling No response. I have asked for my money back when i leave phone messages I've filed complaints with BBB and the attorney generals office as well as call 6 for help!
