Nokia Mobile Phone does not work in Europe, after assured twice verbally that "he sells them everyday to European customers"

On June 2nd I went to this shop searching for a mobile phone. I am from Malta, Europe and I asked for a mobile phone that will be compatible in both the United States and also in Europe. I told the shop assistant that I wanted the cheapest mobile that offers this, as I was on holiday only in the United States.

As soon as me and my husband came into the shop, the shop assistant/owner greeted us with a very warm smile and knew instantly we were from Malta, because he said his father was from Sicily (an island close to Malta). He was very friendly and said that he sells mobile phones to European customers everyday.

He gave me a Nokia 2330C-2 mobile phone. This is a dual band phone. The bands used in the United States are: 1900/850.in Malta, just like other European countries we use the bands 900/1800. Upon inserting my Maltese sim card in the phone (whilst still at the shop), the phone worked perfectly. I asked again whether the phone will work in Malta. The shop assistant/owner said that it will definitely work, as it is designed for Europe. Moreover, he insisted that if he had to insert his US sim card in the mobile phone, it would not work.

My husband later suspected that this phone will not work in Malta, so we did some research on the internet when we were at our hotel. We found out that in Malta we use the European bands, and that European bands phone do not work in the Us and vice versa. We went to the shop again the following morning. The same guy greeted us with the same friendliness and insisted that we are worrying over nothing. He insisted that all the data is encrypted in the sim card, and that the phone will definitely work in Europe. He even told me to call him and thank him as soon as I get home.

On our flight back home, we passed from London, UK. The phone did not work in London, and neither does it work in Malta. This shop is a total rip-off. If anyone wishes to clarify the above, I have the original receipt. The phone was purchased on June 2nd at the price of 110 USD 6.5% service tax, totalling 117.15 USD.
