Hello and to whom it may concern,
I called you office today after being referred to you by the Better Business Bereau. I was told that if I were to e-mail the complaint to you that you would try to get a resolution for me.

On the week of November 3rd my partner and I went on a web site call Inphonic.com. There I applied to buy two Cingular phones. The package was two phones for the price of one. I filled out the application and checked a box on the application to have Inphonic look for companies that would be able to provide service to us if I were to be turned down by Cingular.inphonic asked for a credit card number to verify my age and said that it would NOT be used in the application process. After being denied service from Cingular, I received an e-mail 4 days there after that a company called Liberty Wireless would be the carrier of the two phones.

Now after when I applied for the two phones from Cingular I thought that I would be getting a similar package deal from Liberty Wireless. I asked them if both phones would be on one bill. They told me yes and that the phones were on a shared bill of 300 any times minutes and shared nights and weekends of 3200 minutes. I was not how ever told by Liberty Wireless on the phone that the phones {sent out to us} and service was going to be pulled out of my checking account using the Master card number that I had given Inphonic to use to verify age with.

On weeks of November 10th and the 17th, I received notices from the bank that the checking account was over drawn by 285.00. I was thinking how could this be? My check ledger didn't have those transactions of each phone being charged to the account of 112.00. The over draft fees are 30.00 a piece. That following week after the week of the 17th of November one of the phones were turned off. According to Liberty wireless the card that was used by no means of me knowing, was declined.

Apparently they had used the master card to process the cost of the phones that started the problems at my bank. I used an actual credit card to pay the phone bill on the other 2nd cell phone. After they took the payment, the other cell phone was turned off.By that time I got angry as to why especially with not even getting a bill from them. I called Liberty Wireless Customer Care and told them that I had gotten another carrier for wireless service and to have the other phone shut off. I had told them that I was going to send back the phones to get me money back for the equipment. All of this took place in less than 3 weeks time.

On December the 18th, I went to the post office to send the phones and all equipment back to the return center of Liberty Wireless. I sent the phones priority, insured, certified mail. After tracking the package through USPS, I found out that the package was accepted by Liberty Wireless on December the 20th. I called after Christmas again and spoke to a rep at Liberty Wireless Customer Care and the rep told me that the phones pasted final inspection for resale and that I would be getting a refund 7 to 14 days. I explained to the rep that the Master card that was used was a debit card to a checking account and that the card was no longer good because of the checking being closed.

I requested that a check needed to be mailed out to the address on the phone account. She told me that she would forward the issue to the billing dept so that I could get a paper check for the refund of the phones. She also said to allow 7-14 days for it to be processed. I waited till the 14 of January as it would be the day to receive the refund check for the phones. The check didn't show at the house, so I called Liberty Wireless again. I was told that the billing dept was still processing the refund. I called again in another 3 days after not receiving the check and I had gotten the same story of "The billing dept is still processing the refund and that the issue will be forwarded to them".

On January 17th of this year I was finally able to get a hold on an operation manager named "Nick" and he told me that he would handle it himself to make sure that I would get the check. He also told me that the e-mails to the billing dept were tampered with and that he had intercepted an issue of the billing dept attempting to credit a debit card that was VOID due to the checking account being closed. He told me that he would see to it that I would get the check in a few days. He said that he would get in touch with me and keep me informed. I never received a phone call or an e-mail regarding the progress on the refund check. I called again over the weekend that same week and was argued with before getting a hold of and other manager "Marvin". He told me that Nick had gone for the evening but that according to the notes that he left on my wireless account that the check was going to be expedited soon.

He said an other few days I should be getting the check. I waited again and no check. I have been calling every day since then to speak either to the billing dept or Nick to check on the status. I have gotten no where with everyone at Liberty Wireless Customer Care. I have asked for the direct line for the billing dept and they told me that they couldn't give that out to customers. Last night the 20th, I spoke with a rep who's name was "Jean Tan". She told me that I was never going to get a refund check to begin with! I then demanded to speak with a manager. "Alex Smith" she got on the phone and said that the check was being processed and that it would take a few days to process.

After getting off the phone I found out that through BBB, that Liberty Wireless is a company that is no longer in business. I call the phone number that was with the company info of {410}-542-8200. I called the number and found out that it was disconnected. The only phone number that I know of is a toll free phone # of 1-888-919-7692. Most of the time they are so crammed with calls your lucky to get through. I have also found that other people other than my self have been also ripped off with their money. I found that people are talking about a class action lawsuit against Inphonic and Liberty wireless for what they are doing to peoples personal checking accounts.

You may see for yourself by going to usacomplaints.com. They have forums from x-customers and x-employees and what is going on with the company. Something has to be done to stop this company from further ripping people off. Justice has to be done about a company that is denying accountability of certain misrepresentation.
