Bad business practice concerning merchandise availability (eBay)

This report concerns my experience. This company sells on eBay as well as through a website.

This company has an eBay storefront. I searched eBay for the item in question (A/V receiver - Denon AVR 5803 - B-Stock).

I decided to purchase directly from the eBay store instead of bidding on one of the items. I made the purchase on November 12th using my Visa debit card. The funds were debited on the 13th. I checked the delivery status on the 25th since I had
not received the item yet.

I contacted Dakmart by e-mail and was told on the 26th that my item was damaged. I could either get a refund or wait several weeks for a replacement. I knew that there were several units on auction, so I searched eBay again.

I saw that there were 5 identical units on auction and only ONE
had bids on it. The other 4 were still available. I e-mailed Dakmart again on the 26th to get an answer on why I had to wait
for a receiver while there were 5 currently on auction.

At the same time, I e-mailed the receiver manufacturer and asked them some questions concerning their B-Stock policy. Denon does not honor warranties unless you purchase from "authorized" channels.

Below is the e-mail conversation.

How long is my order going to remain "pending."?

Payment was drawn from my bank account on November 13th.

Is there a problem or are you guys REALLY this slow?

You were sent an E-mail on 11/18/03 that the unit was damaged and did you want to wait or would you prefer a refund. We are still awaiting a response.

I did not receive any e-mail stating such.

If the unit is damaged and I have to wait, then WHY are you STILL selling these receivers on eBay?

You guys need to get your shit straight.

I have asked Denon to look into this matter for me.

I am puzzled as to why my order cannot be filled promptly while Dakmart has 5 of these currently on auction.

I do not understand the DENON issue

We are not Denon
we are an authorized dealer

Do you think DENON can tell us WHO to ship and WHO should wait

Denon will NOT take back our damaged units

Anyway. I am issuing a refund IMMEDIATELY in the MORNING
Please feel free to search elsewhere but please DO NOT purchase from DAKMART in any way???

As you can see from the e-mail, instead of giving me a straight
answer, I was told not to buy from them again.

Well. I guess if I should not buy from them again then maybe others should have the same opportunity.
