Refuses to Refund Your Monies!

July 13, I ordered a cell phone, RIZRZ3-CNG-BLK Motorola RIZR Z3 - Black for ATT Earbud Handsfree $138.99 & 1 VMOT-V3CC Motorola RIZR Z3 Car Charger $4.99
Sub Total: $143.98 S/H $2.49 Total: $146.47. On July 16, A pkg arrived & when I opened it the phone I rec'd said: Motorola Z3 Blue Model #SE6964AH1H1, w / No Earbud Handsfree device, no wall charger, no Owners Manual, & of course NO car charger. I phoned them & emailed them right away. Explaining this. They tried to persuade me to keep it at a fraction of the cost & would refund me the difference. And also, mail out the MISSING car charger & other items not included. I refused on the basis, that this cell phone was NOT compatible w / AT&T & therefore I could NOT use it. The Sim Card would NOT even insert into this phone. They issued me an RMA #, on 07/17/09 via email. On Fri 07/24/09, I rec'd an email indicating that they had rec'd the returned cell phone & would be issuing me a refund w / a follow up from their Customer Service / Billing Dept in a few days.
No email followed & when I tried to call them, NO One answered their phones. So on 08/26/09, I tried another attempt @ emailing them AGAIN. On 08/27/09 I rec'd an email form them stating that they apologized for any delays in refunding me, but that as of 08/27/09, they could NOT directly refund my credit card & could I pls supply them w / a mailing address to send my refund to. Of course I did.
Again, nothing! Several failed phone calls, no replies, so again I emailed them on 09/12/09, asking what the problem was w / my refund. No reply, nothing! Again w / the not answering their phones or msgs. I attempt another email try on 10/26/09, again asking for my refund. NOTHING!!! So I FINALLY got a call in 10/26/09 or 10/27/09 & the woman said that she would have to leave a msg. W / Customer Service, as she personally had NO knowledge of this problem. She would take a msg. & have them get back to me when they came in, (this was around noontime their time). So I made copies of ALL of the emails sent between us & faxed them to their fax #281-530-1175 all 11 pgs. And as of today 11/05/09, I have NOT heard from them by phone or by email. And have NOT rec'd my refund.
