Hello, my name is Daniel from San Francisco.

I recently came across with a very unpleasant experience with a local retail electronic shop in New York. I'd like to find a way to recover my loss and also shut down their operation so that no more victim comes and is ripped off by them.

Here is a case. I was dragged by a street solicitor with a poster telling that they're selling unlocked iPhone. I made a purchase with knowledge based on their explanation "it is iPhone." However, it didn't take too long (like 5 minutes) to figure out that it was not iPhone and they call it "generic iPhone." Though, I knew there was a clear difference between unlocked iPhone (iPhone that you can use it for other operation like Verizon) and generic iPhone (it resembles iPhone but in fact it is fake imitation product from China.)

I argued with a shop owner and requested refund. (In fact, box was already opened by shop owner to test out my sim card.) It was only 5 minutes since I left from their shop and came back. I paid in cash as they insisted. They rejected my request because of there is no refund for whatsoever. I almost spent 3 hours arguing with them to make either full or partial refund, but their attitudes were physically and verbally harassing and non cooperative at all.

Now, I walked away with such a bad memory with out getting any refund. I found out that they may continue this illegal product sales and rip-off for someone like me who looks foreign to them. So, I want to find a way to make your operation to stop and also recover from my financial and emotional loss to deal with them. Please, advise what the best approach to make this action. Either police report, consumer protection agency, reporting to Apple, IRS reporting for tax scam, or legal filing to sue them, I'd love to take your piece of advice to fight against them.

Few more facts for your consideration

-The store didn't issue any single receipt and demanded to pay in cash. I don't think that they comply with local tax authorities.

-The generic iPhone (after my research after this incident) only costs $100, but they sell it at $399 tax as they pretend it was an unlocked iPhone (often costs $400~$500 range.)

-I'm Asian but educated and lived in the States for many years. Though, they harassed me with my lack of understanding in terms of language, pushed my body out of their store, yelling and verbally insulting me.

-Many products have price tags at least 3-4 times higher that their market price. Many foreigners are dragged to this place and ripped off without knowing what's happening to them.

-They sell refurbished or second-hand products like they're pretending they are all new. I saw them to put unpacked items with a new package and pretend and re-stock them again.)
