Took $3,069 for a scooter 3months ago and will not now accept our cancellation and refund our money. Have lied to us several times about shipment

On August 2nd of 2008 we ordered a Yamaha Hybrid modified scooter from Q Electric in Ensinitas Ca. And sent them a cashier check for $ 1500.00 with a promise to charge the remaining $1569.00 on our new credit card as soon as it came in. It came in on Aug. 8 and we called and put the remainder on the credit card. They said they would have the scooter in within the next 2 weeks and would do the modification to it themselves.

In 2 weeks we called and they said they got the scooter in and was working on it now, and that it might take 2 weeks because they had other special orders to do also. We called back in 2 weeks and they said it had already been shipped out to us and we should get it in 2-3 weeks. We asked why it would take that long to get to us. They said well they had to ship out a lot of other special orders to so it would take awhile to get them all delivered.

We called them 2 weeks later and they said they decided to have the manfacturer in China do the modification instead, and that it would take about 2 weeks for them to get it. We called again 2 weeks later and they said they would for sure have it in 1 more week. This went on until Oct. 16 when we finally called them and cancelled the order, but they would not cancel it nor return our money.

When we have called them they have given us the run around and told us lies time after time. When we called to cancel the order the young man Lenard who took our order said we would have to talk to his boss John Long. But John Long was conveniently either out of the office or on another phone. When we finally did get hold of him he said we had to talk to Lenard because he's the one who took our order. Lenard said we had to talk to John, we said he said we had to talk to you.

Lenard replied let me look up your file but instead put us through to John Longs phone which answered with recording. And when we would call back and ask for John Long then Lenard would tell us that John was on the phone with another customer but would positively call us as soon as he got off the phone. Three hours later he still never called back so we called again and Lenard said he just left for the day.

So my husband called the next day and John Long answered the phone and my husband told him we wanted to cancel the order. He tried to give the same old story about it'll be there in another week. He never did say he was cancelling the order or returning our money and would not talk to us when we called the next day. But Lenard said he would give us to accounting, that they had to take care of it. They didn't know what to do about it either.

So that's why I'm writing this report today Oct. 25. We need help to get our money back. We told them on the 16th that if they didn't send us a check by Oct. 23 we were going to start taking actions against them. It's past the 23 and they won't tell us if a check has been sent out to us or not. They just say they don't know anything about it.
