BUYER "OMITTED" the MISSING vital components to a camera, and described it in the Ebay description as "fully Functional" I filed a dispute with paypal/ebay they told me that this does not qualify for "Significantly Not As described"... Logical arguments sent to representatives of EBAY / Paypal fell on "dumb"-ears. THIS IS MY CONCLUSSION: ATTENTION ALL Scammers, CROOKS, Frauds, CHEATERS, and other Internet Criminals if you sell an item ON EBAY and by "accident" omit the MISSING COMPONENTS OF THE PACKAGE & and please remember to call it fully functional (or Complete) package. The Ebay/Paypal will protect you from any disputes/claims filed against you. Because this does not fall under the "sufficiently not as described" category. This is how to scam ebay, paypal and specifically ebay buyers. Dont believe it... Here is the proof... That ebay/paypal reps are morons (this is too general, I meant to say that most of them are morons)

To work directly with the seller to find a resolution." As for the seller, the seller in question has intentionally mislead me in the description, and has refused to refund my money in exchange for the "fully functional" camera. That sounds like a reasonable thing to do, right?

If the argument is that I am attempting to "back out of the purchase", I paid the money, If I did not intend to complete the transaction WHY WOULD I PAY THE MONEY??? And After I consider this claim closed, I encourage you to monitor my account you will be seeing a purchase of digital camera. And if all things being equal I will resell this "fully functional" camera with the exact description of the seller that sold it to me. I will then expect the Paypal to protect me in the same manner. And remove any negative feedback that I may get as the result of such "unethical" sale. If Paypal does not resolve this right now, I promise you, I will list this item for auction, and I will sell it. Paypal will then be left to straighten out this mess yet again. Additionally I will then advise that buyer that will buy this camera from me, to relist it again, and again, and again, and again, and again.

FACT: The seller stated in the description "fully functional"
FACT: The camera in question arrived with out a charger, therefore cannot function.
FACT: PAYPAL compounded this fraud by making a summary decision which left me without the money, and without a FULLY FUNCTIONAL CAMERA.

FACT: The determination was made without even a thought to protect a buyer who has adequately layed out, and described the problem.
FACT: Fact the Paypal's representative did not offer any Rebuttal of the Factual arguments presented by the buyer.

Fact: the camera is not fully functional with out the charger. Which the seller intentionally omitted and misrepresented, omission is also misleading and fraudulent.

If Paypal is willing to review this matter and LOGICALLY EXPLAIN THEIR POSITION, and backup their arguments with facts, please do so. Explain to me where my logic is wrong, in a "nut-shell" HOW IS THE CAMERA "FULLY FUNCTIONAL" WITHOUT THE CHARGER.

I offered this resolution... I get a refund, the seller gets his "fully functional" camera back, this is a reasonable and arguably amicable resolution of this mess.

If you disagree, then you must believe that I am attempting to scam the seller, and if that is the case, please provide me with your legal address where notices may be sent by mail. Because I have had my fill of "stepping on the same rake" over and over again. I will not allow you to treat me like a scammer, when in fact I am the victim of a scammer. If your plan is to keep throwing back your policies at me, hoping that I will just give up and go away, then you leave me a very limited number of avenues to resolve this, and this also speaks to your contempt of your buyers/users. Paypal obviously does not consider my claim important enough to give it a comprehensive evaluation, and this actually is a very fruitful conclusion that any reasonable/potential user of paypal could reach. I am very good at reaching conclusions, and I begin to wonder if anyone will agree with me.

I will wait for your response no more then 48 hours.

5/19 13:39 PDT - Buyer: I have provided detailed information in the beginning of this Dispute and follow up post. The seller has presented conflicting information. Fully functional — means fully functional, No Charger — Not Functional. Charger is a vital component without which a camera cannot function. How would you like to be expecting a FULLY FUNCTIONAL camera. And get a dead battery, dead camera. I tested the battery, not even 0.01 volt. This battery has been dead for a while. I don't care to find out any more I will be happy to return all the contents of package that I received, after the full refund. Also please review sellers buying history, he might be trying to resell an item he bought.

5/8 12:33 PDT - Seller: I lost the charger, but it really does not matter WHAT happened to the charger because in my listing on ebay (120251752882) I did not mention that I would be including a charger. That is the point. You bid on a camera that did not include an AC Adapter. As far as my description of a fully functional camera, it IS functional, you just have to charge the battery. When I first bought the camera, I had to charge the battery also, but that does not mean I can return it back to Best Buy and claim that it should have already been charged.

5/8 04:45 PDT - Buyer: I disagree, "fully functional" means fully usable, the camera arrived in an "unknown" condition. The camera is dead. The Battery is fully discharged, and if as you say it was used by you for about 1.5 months, the battery should still carry a charge. Your reference to "Minor Signs of USE" is not disputed, I never made an issue of the expected scuffs and scratch marks, and this is an unnecessary change of subject. AC Adapter is a vital component, such an omission puts in question your (in good faith) argument of "fully functional" camera. Moreover the AC Adapter is a standard component. How were you using the camera for 1.5 months without the AC Adapter? I would like to know how you charged the camera, and do not attempt to continue to mislead me, by saying that you charged it through the supplied USB cable, I left the camera connected to a powered USB port on my computer for over a half hour and the camera did show any signs of life. How were you using it for 1.5 months if you didn't have the AC ADAPTER? More to the point WHAT HAPPENED TO THE ADAPTER? Are you still using the "camera specific" adapter in some way? Is your argument that the adapter was not included when you bought the camera? If that is the case that implies that you could not have charged the camera and that makes your argument that you used the camera for 1.5 months — suspect. That also makes the "fully functional" argument — suspect. You are trying to make it sound like like cameras are always sold without a charging adapter. I suspect you knowingly and intentionally omitted the disclosure that the camera was dead, and that the AC adapter "absent" The interesting part is that you purchased item #120211229306 and now that user is no longer a registered user can you tell me what that Item was? And why that user is no longer "registered"?

5/5 20:34 PDT - Seller: The camera was listed on Ebay as a USED Nikon S51c. The camera is about 1.5 months old and it has been used, like I mentioned on the description. Because its been used by me a couple times, the battery of the camera is obviously completely dead. Also, the item arrived to the buyer just as described. I never mentioned on my ebay listing that I was going to include a AC Adapter. The item number on ebay is 120251752882. You can see there that I never mentioned I would include a charger for the camera. And moreover, the reason I took the battery out of the camera before shipping it to the buyer was because that was the way it was shipped to me, so I thought that should be the proper way to ship it, without the battery in the camera. So in summary, the listing advertised a used Nikon with minor signs of use, which is correct. It is a fully functional camera, which is also correct. And I never said the AC Adapter was included, so it wasn't shipped.in the Box The Nikon Coolpix S51c ships with the following items in the box: Nikon Coolpix S51c body (Silver) EN-EL8 Rechargeable lithium-ion battery USB and TV Cable Strap Printer Dock Accessory: Dock Insert PV-12
5/2 12:38 PDT - Buyer: I have not heard from you for the past TWO (2) days. If I don't hear from you by Tuesday Morning I will escalate this dispute to a claim.
4/30 14:21 PDT - Buyer: I received the item on Wed, Apr 30th. The item will not power on, the AC Adapter is missing, the absence of which is not in the description, I have tested the battery with a volt-meter and it is DEAD. If as in the Description this camera is only 1.5 months old, the battery which was not shipped inside the camera (could not have discharged, accidentally) should have still had a charge. Unless you are able to explain why the camera will not power on, why the battery is completely dead, why the absence of the AC adapter was omitted in the item description, I will be sending this item back to you (registered, with return Receipt) after the full refund. To paypal/ebay staff: please note that i initiated the dispute within hours of receiving the camera, the camera will not power-on, there is not a possibility of damage in-transit as the camera box was intact. I have pictures of the contents of the shipment. Also please note that ac adapter was missing/omitted from item description. Thank you. Lev agency

and if you think that i am pissed about this, you better believe it... Especially since ebay disabled my ability to leave negative feedback, and not just for that seller, but for all sellers... This is unethical, and before they tell me that this is some "glitch" on their servers. Save it. That seller is getting away with a lie of omission. And ebay / paypal decided in favor of that seller. Think about that next time you are buying an expensive item over the Ebay / Paypal System. They will not take your side, they will dispose of the "disputes/claims" as soon as possible, with their patented "cookie-cutter" decisions.

I am hoping that this will help someone... And by help i mean leave negative feedback as soon as you escalate the dispute to the claim... Don't give the "Dynamic DUO" PAYPAL/EBAY a chance to do their "justice"
