Seller describes items as brand new or mint condition. Items arrive very much previosly used, and incomplete

I bought a Blackberry 7250 PDA Verizon Wireless phone from Michael Patel, the Blackberry was recieved on September 24.in the auction the description advised a battery for this model phone would be included and that the phone would be in mint condition and fully working. The battery was not included in the shipment with the phone, and the phone has had the web browser disabled. I emailed the seller that night from my Yahoo email, as I was at work and unable to access eBay. The next morning I emailed him from eBay, just to be offical with the process. I also requested his information from eBay so that I could try to phone him. September 25 I phoned him and left a voicemail letting him know the battery was missing and that I had double checked the auction description, he did list with the battery included. I carried the phone to a authorized Verizon Service Center, they advised me that I would not be able to get a new battery from them due to the age of the phone.

I went online and bought a battery for the phone and found that the phone's internet browser would not work. I carried the phone to the authorized Verizon Service Center again and they advised me that the phone's internet browser could not be enabled, and I again emailed and phoned Mr. Patel on October 14 with no responce. The seller would not reply to any of my attempts to contact him.in fact he reported to PayPal and eBay that he had worked out this problem with me. He never contacted me, or responded to any of my emails.

I only asked that this seller either refund the money I paid for the new battery, or fully refund the money for the phone after I shipped it back to him. He not only refused, but left nasty feedback rating for me after I tried to resolve the problem quickly, and he notified PayPal that he had shipped the battery, and that he had offered me a full refund (which he never did).
