Purchased phone on ebay, seller said it was tested to work, but verizon says different

I purchased a phone from this company on ebay and it was guaranteed to be tested and work from the seller. However, I charged the battery and phone for 4 hours with no sign of life. I took it to verizon and had them diagnose it and it was returned with a error relating to the battery and verizon also commented the battery was third-party. I then told verizon I find it strange the seller was able to test the phone that did not work (Assuming he used the battery that was sent with the phone). If not, the seller still should have tested the phone like he said he did with the actual battery that was going to be sent with the phone to encourage a real accurate test.

I am still waiting to hear what the seller is going to do about this incident. This is my first lemon because I normally don't purchase on ebay.
