Brand new phone died, no signal, dropped calls

I purchased a Cingular 3125 phone and signed up for a family plan in Nov.in March the brand new phone stopped working so I called the warranty department. Warranty said to go to the store to check the battery and charger.

The store said the battery and charger are fine so they told me to call the warranty deprment again. I call again. After a long time on the phone the warranty technician said that these phones are defective. There is a problem with their charging dock. Naturally, I said that I did not want this phone anymore. I paid full price and I wanted the option of getting a different model.

Warranty department said that it was not possible since there is no recall for these phones. They had to send me a refurbished phone but the warranty on the refurbished would be the warranty of the original. So I would have only the months Apr-Nov left for warranty. That is totally unacceptable.

I bought the new phone with a year warranty. The phone turns out to be defective so how come Cingular does not back up their phones. This is a CINGULAR 3125 not a Nokia or any other make. Cingular does not manufacture these phones but they brand them so they should take responsibility.

Anyway, I filed a complaint with the BBB and some idiot called me from the president's office of Cingular. During the first 2 minutes of the conversation, the call DROPPED, so she called me on the land line. I told her that I will not accept a refurbished phone and I cannot send my original phone back since I had sensitive financial information in the phone's main memory. She basically told me tough luck.

Ever since I have been with Cingular, 70% of the calls drop and the quality of the calls is almost non existent. Based on these facts:
-call quality
-dropped calls
-stupid warranty on a defective phone THEY brand and admit that is defective,
I asked for a contract termination without the fee and it was refused.

Finally, I thought that the big split of AT&T was a big deal. Who is letting these unethical companies merge again. They are on their way of becoming a monopoly again and I just wish that someone can stop them. If you are thinking of switching to cingular, dont. All those commercials are a big lie.
