Sold defective product and refused to replace, service, or refund ripoff

On 2/16/06 we purchased a Toshiba 62HM95, from Donny Phitzer, invoice #3544326-001, that turned out not to be fully functional. AFTER we brought the TV home our cable company couldn't install our cable due to a software upgrade needed. We called Toshiba and had to order the part from them. After the upgrade the Tv still didn't function properly. Conn's was made aware of this as soon as we found out it was not a Cable company issue. Well within 10 days.

At that time we were told Conn's service would come out and take a look at it. Repairman came said he would order a cable card reader and come back to replace it. When he did get the part, which turned out to be the same software upgrade we had already done (Tony was aware of the upgrade already installed) not the cable card reader as stated on the first visit, Tony, (repairman) came reinstalled the same software and stated it was the Cable company, and said he didn't know what to tell me but I hope you get it fixed and good luck with it.

I have made call after call to both Toshiba and Conn's. Conn's store manager Troy stated that service had dropped the ball and he would have to do something and he would get back with me. Still nothing. Several more phone calls to Conn's with Troy not returning any of them. After 2 months and the TV not functioning since the day of purchase I called my lawyer to start proceedings to sue.

The same day an authorized service repairman for Toshiba, Cyrus with ACT Electronics called and said he would come out and look at it. I called my lawyer and told him to wait. Once here ACT Electronics decided to order and replace the cable card reader.

Another week passed and Cyrus did come out and replace the cable card reader and the TV functioned until 5/28/06 and Conn's refused once again to help with the situation. Stating it had been to long since we purchased the TV and we didn't purchase the warranty.

We declined the extended warranty as clearly stated on our receipt. The total cash purchase for this TV was $3085.06. We are a store credit for the amount paid or full refund. Other companies involved have extensive records of this situation, including but not limited to Cox Communications and ACT Electronics.

We have purchased several TVS from Conn's before and are very disappointed at the lack of sevice from them. Their repairman, Tony, also called me and told me that he would not come out and look at it again, I asked "So what you are telling me is that we paid over $3000.00 cash for a new TV that was defective and you are not going to do anything about it and it is our problem?" Tony's response "Yes mam'" We worked with all requests made by Conn's to let them try to fix it first, which they didn't even attempt, and after 3 months see no other resolution then to file complaints with BBB, FTC, Attorney General, Rip Off report and our lawyer against Conn's and Toshiba.

We are seeking either a full refund or store credit for non-defective merchandise like we were sold to begin with.
