This company sends me a collections notice about an apartment rented over 2 years ago. We reached a settlement with the complex and I thought the case was closed.
All of the sudden I recieve 2 letters on the same day, 6/17/03.1 stating that they have been retained to collect this debt, this is the first I heard that this dept was still standing. This letter is dated 6/11/03.
The same day a 2nd letter says they are "investigating my financial history" to see if they can sue! Then today I receive a 3rd letter from their legal department saying they are going to sue me in 10 days! This letter is dated 6/18/03! That's right 7 whole days after they dated the first 2 letters! By the way all 3 letters were postmarked 6/17/03!
I called them to get this resolved and talked to this total bitch of a woman who screamed at me about her "40 years as a bill collector" (Side note: Thumbs up lady on holding a low paying menial job like that for 40 years!) So I should not try and "bull her" and just pay the bill! Well I got tired of being yelled at and hung up on her. I called back and asked to speak to someone eles. I was given to someone else and asked her to explain the supposed debt to me and to provide proof of debt to me. She explained it to me and said she would send it out but I still had to pay because she was legal and she was in charge of filing the lawsuits and she would file in 10 days.
I thought about it and and decided that 1700 dollars is not worth the time off my job to travel over 150 miles down to San Diego to fight this even though I am in the right. This would be a hell of an inconvenince to me, my partner, my job, and I just frankly don't want the headache.
I called the legal girl back and said even though I do not agree to this debt I will pay it under protest, the FULL AMOUNT they were seeking. All I ask is that they remove it from my credit report which I have spent years trying to build up. She stated that she could not do that because it would be FRAUD and against the law! Now we all know that this is not true! I had enough of their ignorant games and said take me to court.
I am going to call someone, not sure who (If anyone knows who controls collection agencies in California please let me know!) and try and get this settled. Just thought others out there would like to know how they do business. If I can get one single company to decide not to hire them for their unethical ways then I am satisfied.
