I was hurt 03/29. I'm a truck driver, and I was rehired to Swift Transportation in Fontana California. I hurt my Back, Right Side Ribcage, (felt like being stabbed with a red hot poker) for 4 1/2 bed ridden months, as well as my right knee.
My injuries have been confirmed as work related through MRI's, X-Rays, Multiple Doctor reports, and very recently an AME exam that went my way. Only the defense now says the AME doctor don't know what he was doing.
To Date, 03/24, being 4 full years laters, Gallagher Bassett, and it's bottom feeding attorney in charge named Janet Rice Kuntz out of San Bernandino California has denied me 100% of my W/C benefits, and have not paid me one penny of what I'm legally and lawfully entitled to.
Janet Kuntz being the bottom feedeing attorney that she is, has consistantly and wilfully denied me payment of T/D for absolutely NO legitimate reason, even while all the medical reports, mri's, xrays, and a new ame exam has verified my injuries as work related.
The California WCAB Judge Nancy Gordon in charge of my case, has allowed her court to be over run and lawyer driven by the defense.instead of taking charge, and making a ruling with all the evidence in hand, she prefers to entertain the defense with all it's constant never ending delays, cancellations, and now out of country vacations when MSC's are scheduled.
A (DOR) was filed at the end of Jan. 2008 for an MSC. So instead of notifying the WCAB Judge Gordon, months in advance of an out of country vacation for the defense, the defense waits until an MSC date was scheduled before notifying the court and causing yet another cancellation until who knows when?
Meanwhile, I've depleted my bank account, my nest egg I had saved, and now me, my wife and my 2 almost teenaged kids are living on only my wifes paycheck. I have other medical conditions now brought on by this on going 4 year W/C case.
I can't get a job in my usual occupation because they do background checks, and companies don't want to hire anyone with an open W/C case, as they are afraid I'll use their W/C to cash in on my injuries.
Bottom feeder Janet Kuntz wants to settle my case for only $10k total. My T/D benefits are worth nearly $15k, then there's the 3 1/2 years worth of penalties and interest, and no work due this open case.
I want and demand 100 % of what I'm legally, and lawfully entitled to due my injuries under W/C.
I'm looking for a California attorney that deals in class action lawsuits. I want to start one against Gallagher Basett, and all it's attorneys, and insurance adjusters who for no legal reasons keep denying legitimate W/C claims.
There's too many of them out there, I've read many many a case here upon the net about Gallagher Bassett, and found out that I am not the only one, they are cheating and dealing in bad faith with as I previously thought.
Any California class action attorney who is interested then please immediately contact me here. Something needs to be done, and Gallagher Bassetts ethics need to be brought into light by way of 20/20 and 60 Minutes etc...
Should my case settle for a FAIR settlement, which means 100% of everything that I'm lawfully and legally entitled to before such a class action suit can be filed, then I still want to be part of it for principal if it's allowed.
The 2 false statements Gallagher Bassett makes upon it's main website is;
1.) "we lead with quality", and 2.) "making sure your claims are settled quickly, fairly, and cost effectively". Gallagher Bassett does neither.
