Won't pay me my money

I worked for Ranger American from the middle of August to the middle of December as a Territory Account Manager.in the last couple weeks of November there was a monetary incentive provided for the amount of appointments I "ran" and contracts I got signed for Ranger American builder and non-builder accounts.

My bonus check I was supposed to receive was $550.00 based on the incentive plan. I knew that from prior bonus plans I wouldn't see a check released to me for at least 6 weeks, which was to me, not a problem.

On December 9th, my girlfriend fell down the stairs at her friends house and broke her left leg and her back. Obligated to help her I informed my supervisor that I wouldn't be able to run the required appointments between the hours of 5 P.M. And 7 P.M. Monday through Friday because her daughter needed to be picked up from daycare and I was the ONLY person who could do it.

I knew that these were our "peak" hours to generate leads but I told my supervisor that I would appreciate the flexibility that they could provide for me under these unfortunate circumstances. My boss said, "Well that's what you get for being involved with a girl who has a kid." She also told me that she'll do what she can to keep her supervisor off my back but she doesn't know how long that will last.

The first Saturday since my girlfriends accident I was ready to work but did not get one telemarketing lead. Telemarketing leads on a Saturday were always in abundance. The previous two weekends I was given a total of 8 leads and now all of a sudden zero. I thought that this was mildly strange and when I spoke to my boss she told me that I said I wouldn't be able to work that Saturday. Obviously there was some sort of miscommunication there, so I shrugged it off as not a big deal.

The following week I attended the mandatory meetings, ran my appointments and door knocked as I was supposed to except between the hours of 5-7 pm. The very next Saturday again, not one lead. This to me was starting to seem like I was being pushed aside due to the fact I was no longer the "golden boy" (as I was often referred to by my boss) because I wasn't fully obligated to working during the hours which mattered most.

The start of the work week after that my girlfriend and I got the news that surgery for her leg was necessary. I told my boss that in order to take care of my girlfriend I will more than likely have to take a leave of absence. She said that wouldn't be possible because I haven't been with the company long enough. She told me the alternative was to resign and when I was capable of coming back to work that all I had to do was re-apply to the company and I'd be re-hired. This seemed the best avenue to take so I agreed but she told me that she will find out exactly what needed to be done for that to happen. She never contacted me about that again.

After about another 2 weeks I received a text message from my boss saying I got my final paycheck. She met me in a parking lot to give it to me. At that time I asked her about my bonus check of $550. She said that the checks haven't come in but she'll let me know as soon as they come in.

2 weeks later I asked her if the checks came in. Her response was yes, but I didn't get a check because my last commission check was in the negatives and my bonus check was applied to it. I asked her how that could be but she couldn't answer because she didn't have any of the paperwork in front of her at that time. She said we should sit down and figure it out.

One of the ways that my paycheck could be in the negatives would be from commission chargebacks.in order to get my full bonus check revoked from commission chargebacks I would have had to have at least 3 commission chargebacks at once. To me this is unheard of considering I have never witnessed on any one of my paychecks any chargebacks whatsoever nor have I heard of any one of my former co-workers having that many chargebacks at once. There is no proof of any chargebacks because I have never received that paystub my boss said was in the "negatives" nor have I heard anything from that company since.

I'm very disappointed with what happened with my previous employer. Money is very tight due the situation I'm dealing with and I firmly believe that they withheld my check without reason.
