On February 1, my husband and I went into Gallery Furniture here in Houston to purchase new living room furniture. Although we had the money to purchase the furniture in its entirety, we decided to see if we could qualify for financing so that we could rebuild our credit after two costly divorces.

The bank Gallery Furniture uses did not approve a $3,600 loan, even with a $1800 deposit making the loan roughly $1800. Gallery furniture referred us to their "second chance" finance company.

Let us make this short: We were told they would keep 60% of the payment and 40% would go to pay off the furniture. Our goal was to make payments for 6-9 months and then pay it off.

Gallery Furniture made a deal that if we bought the scotch guard they would deliver for free however; TRS is charging an $89 delivery fee, even though they did not deliver the furniture. They set up two accounts, telling us that it would help our credit however; this is what happened with that "helpful advice":

IF you are late, you receive TWO late fees. Late fees typed on the contract we have shows $5.00 PER ACCOUNT however, TRS charged $15.00 PER ACCOUNT. Please keep in mind that the late charges begin on the 3rd of the month, as we are to make payments on the 2nd.

With respect to the due date: TRS calls on the 3rd of the month and demands payment or they will come and take the furniture. Please keep in mind that the typed contract I have shows that the furniture is not in default unless it is more than 10 days late. There is nothing in the contract that states anything about a grace period or that they will come and take the furniture if you are one day late. Please do note that we were late only three months (during the summer) and they payments were never more than 6 days late.

They have called my work, my co workers, my mom, my brother and have left text messages on my cell phone as early as the 4th of the month stating they will take legal action if the payment is not made by 7pm that day. TWO DAYS LATE and already harassing and making threats!

Please also note that I put almost $1800 down, yet they cannot account for where over $600 of that payment went. I have been complaining since June as to where the rest of the down payment went, why I am being charged $10 x 2 a month for late fees, as well as the following:

When we looked over the contract, the contract states that they DO NOT Carry renters insurance. We were advised that we would have to do this on our own HOWEVER, they have been charging us renters insurance, and TWO Separate charges for each account. Therefore, we have been paying $18.61 & 18.74 every month in renters insurance just for the living room furniture.

Now, we live in an apartment, we most certainly could have our entire apartment insured for roughly that or a tad more. I have been complaining about this since June yet they keep charging me for this until I finally go a hold of a new employee who told me I could cancel this at any time.

Hmmmmm... They must not have told her how to screw people before she began working there.

Both of my contracts show the following:

NO delivery fee at signing, but there is something listed under other charges for the amount of $79.99 for BOTH ACCOUNTS. They are charging me $160.00 to deliver furniture that they DID NOT Deliver, but rather Gallery Furniture who also waived our delivery fee if we purchased the scotch guard.

They keep 60% of your payment, yet they still charge a $9.95 processing fee each month. REALLY???

There is a sales tax for each account: $16.31 & 16.42 as well as a property tax of $0.85 & $0.81.

On one of my accounts, if I were to pay it off the 1st day I purchased it, I would have to pay $1335.60 however, we paid off the sofa completely therefore our payoff for that particular account was to have been $335.62.

Please note TRS is still charging us the same amount of sales tax every month for a $1300 account even though the account payoff was only $335.62. Please note this was the payoff for that account on February 2 and that by June 3 I learned that I owed $395.00 on this account.

Funny, I owe more after making 5 payments. Hmmmm... Please keep in mind that I did not pay attention to this until they called and started harassing me because I was TWO DAYS LATE.

I informed them that with summer, I have two children in daycare and that cost me over $800 per month. They informed me they did not care and that they did not have any grace periods however, the contract shows nothing about having to pay by the 2nd or they can come and get the furniture. The contract only reads that I am not in default until 10 days late.

Needless to say, I am still awaiting the regional managers phone call to explain why I was still being charge renters insurance on BOTH accounts even though I had been disputing this since June. Also, why my late payments were $15.00 a month instead of $5.00 and why they charged me TWO $80.00 delivery fees along with the $600 of my down payment that CANNOT be accounted for!

PLEASE DO NOT USE THIS COMPANY! They will take your money and then find some BS reason to come and take your furniture. IT IS A WIN WIN FOR THEM and you are screwed.

We do have an attorney working for us with respect to their scandalous actions and/or thievery. I assure you we will keep ALL consumers POSTED
