My family and I had fallen into hard times. This was about 2 yrs ago. The yr was 2000. Our present mortgage was heading into foreclosure proceedings. OCwen bought over the mortgage from southern pacific funding corp. Now 2 days before our house was to be sold on the auction block, we signed a forebearance agreement with Ocwen. We paid Ocwen 5,500.00 cash by western union. And started to pay the mortgage for $1500,00 each month. Sent the payments by certified bank check.
We did have an agreement that we could pay the payments no later then 16 of each month. Have the letter saying this from the person we orginially signed the agreement with. Now... A yr ago 2001 they tried to pull on ur that we have escrow account. Meanwhile we pay our own taxes. They are charging us interest on taxes that we pay ourselves. Then tried to raise the payment a 1000.00. I talked to finally one of there reps 3 months later. And cleared up the whole situation.
NOw we come to 2002.in July we get our payment back in the mail. Tried calling the person who is in charge of our account. THey never got back to me. Now Aug comes along, I send the july payment, and aug payment to ocwen. Again I get back both payments. I call again the person in charge of the situation. Again nothing. I open a piece of mail, from a real estate broker, where there is an article about my house being sold as an auction sale on sept 5th.
Finally the person Rick Turner gets back to me. Tells me there is no deal and that our house is being sold. Now I say to this person, how could this be happening when we have been paying diligently for 2 yrs without skipping on payment. Told my attorney and he really did not do much. He called up rick turner, and rick turner said to him that we have not paid our mortgage for 2 yrs.
Meanwhile I have ever receipt that I ever sent to this mortgage place. My lawyer said to me that I should just refinance. This was a week before the sale of the house. I went to the supreme court judge, who had signed the papers a long time ago on this case. The judges sec told me to have an order to show cause done by my lawyer. My lawyer was reluctant to go ahead with the order, but he finally did. So right now our house is ok. Not great but ok. But did find out so many other people have been taken over the coals from ocwen, have all the articles on them. Also when we signed the forebearance agreement with Ocwen, they never turned into papers to the court house saying we were paying them and made a deal also.
So the papers were still open and that meant at any time they could go ahead with the proceedings because the papers were never taken care of to begin with. Have been told that ocwen had criminal intent to take the house away. Plus also was told that ocwen did want the house because of the equity in the house, and where it is located.
BEsides all that, not telling you what mental and emotional anguish this has put on the family. THere is probably more that I have not added to this incident, but do have more information if needs be.
