On 12/7/06 I received a letter from the crooked company on an alleged obligation for Banfield Pet Hospital Wellness Plan for $76.88. Even though I have know for a fact that the account was an error, I paid the fraudulent claim because in our society scum organizations like I.C. System can thrive using extortion tactics to demand payment under the threat of ruining people credit reports if you don't pay. The government allows it to go on. Even people with legitimate disputes and follow the law, still find their records corrupted by dishonest and incompetent organizations like I.C. System, Inc.
I made it perfectly clear that I do not own the claim and that I was tendering the amount of the fraudulent claim knowing their claim was under false pretenses, under duress of the extortion tactics that they are known for, and that the account validity was being challenged under the FDCPA. I informed of my intent to seek legal remedy under the Consumer Protection Act as amended under the Commonwealth of Kentucky Revised Statutes.
Since they made it a point to inform that their calls are recorded I stated my case for the record and then in my letter disputing the claim, I demanded a printed transcript of the conversation. I made it a point to inform them that based on my intent of filing legal action the recordings were subjected to Rules of Discovery and Kentucky Civil Procedures.
The idiot on the phone stated that I had to prove I didn't owe the obligation. I informed the idiot of the logical fallacy of proving a negative. They are required to prove I owe the obligation and when they can't meet that burden, they are in receipt of fraudulently obtained funds under a false claim, and unlike most consumers, and I will haul them into court on the issue. You can be sure of one thing: Banfield and I.C. System collectively are going to spend a lot more money on legal processes and fees on top of the refund of the money they fraudulently collected and more.
I thought it would be appropriate to place this report under the category of prostitutes based on what they do to you for your money.
