"Carpeteria Ripoff", I thought C.O.D. Means cash on delivery. They kept the remaining carpet, sold it, and put a lien on my property!

Back in 1992, I visited Carpeteria in Salinas. I told the sales person that I was thinking of recarpeting my entire house with white tweed berber carpet, and being they did not have it in stock, he offered to order a 100 foot roll of carpet telling me that I would not be obligated to purchase the entire roll and only pay for what was actually installed. I agreed that I would only pay C.O.D., "Cash on Delivery" upon completion of the installation of the carpet actually installed from the roll. I paid the installer as agreed, and he was to take the check back to the store manager, of which I assume he did.

I paid for the carpet that was actually installed and thought that would be it. They installed the carpet in 3 rooms and a small hallway, and I paid C.O.D. For what they installed off of the 100 foot roll of carpet. I presume that the installers took the remaining carpet back to the store. They only installed about 30 yards of white tweed berber that I paid for C.O.D.

I let the Sales person know that they cracked the bottom portion of the marble faced fireplace with their kicking tool, and did not secure tightly the underlayment and it thumps when walking on it and still does. They ignored me, and would not even come over to settle this, as they were setting me up to rip me off.

After several months, the sales person was bugging me to install the remaining carpet; and I told him that I decided not to do so. He threatened to sue me, but I reminded him that I had only agreed to pay for what was actually installed C.O.D., and he tried to pressure me, and said they would sue me if I did not install the rest of the roll.

They did take me to Court, and I and I explained this to the Judge as above, but he was lied to by the apparently sleezy spoken sales person, and ruled in their favor for me to pay $3000,00 for the remining roll of carpet that they kept and sold to others. Maybe the Judge has the carpet in his home or the installers do, I do not know. They put a judgment on my title, and when I went to refinance, this came up after 13 years.

At the time of the installation of said carpet, the installers noticed that I had some vinyl-lino.in my garage, and offered to install it on the side on their own time during the weekend. I paid them directly for their labor as I had already paid for the materials. The upstairs was done in rose pink cut pile, and paid for it via C.O.D. Also. I do not owe Carpeteria anything. They kept the remaining carpet, resold or whatever with it, and are trying to rip me off for attorney's fees, interest and carpet that I did not receive. This is a brutal way to treat a customer. They refused to come over and measure what they actually installed, and prove to me that I owe them anything.

Now in I am getting ready to redecorate, and will be removing the entire carpet in my home and putting in hardwood, and must get this matter resolved so that I can proceed, but this fraudulent lien is holding me back. I am still inviting Carpeteria to come over measure, and settle this gross unfairness towards me of trying to rip me off without any basis.

I am warning anyone in need of flooring to steer clear of Carpeteria unless they change their ways. They cannot be trusted for their word, or their warranty of lifetime customer service, because they do not service the customer. They apparently service themselves by ripoff of the innocent customer, and bring the nightmare of litigation and liens, and do these despicable things to unsuspecting homeowners for their benefit.

Carpeteria now has a new showroom in Salinas allegedly purchased with ill-gotten gains of customers who don't challenge their unscrupulous ways of doing business. I will be sending a copy of this writing to them, in hopes that they will realize that I am not the only one who has been ripped off by them and seeks justice, as it was not served in Court.
