Advantage Builders, Inc. Defaults on building contract by failure to provide a residential structure that is watertight, free from water infiltration, located within the water table without adequate waterproofing, located within the water table without adequate interior and exterior drainage and in violation of the New York State Building Code, including Chapter 18, Sections 1801 through 1807.
Advantage Builders, Inc. Became away of the height of the water table, and its impact on the construction of the home at the very beginning of this project when one of the foundation walls collapsed due to hydrostatic pressure. Additionally, standing water was seen in the excavated hole for the foundation. Two separate professional engineers hired by the buyer examined the property and provided written notice to Advantage Builders, Inc. Of the potential for water problems and the necessity to adequately address the water problems prior to completing construction. Having been apprised of the water condition, Advantage Builders, Inc. Failed to take even the minimal steps necessary to raise the height of the bottom of the foundation out of the water table.
Advantage Builders, Inc has failed to perform the construction in a good and workmanlike manner. Advantage Builders, Inc has failed to provide adequate drainage, waterproofing. Advantage Builders, Inc has constructed the foundation too low, knowing that the bottom of the excavated hole was dug into the water table. All of the foregoing constitutes a material breach of Advantage Builders, Inc. Contract and a violation of the New York State Building Code.
