Foundation warranty worthless

I purchased a home from Beazer in 2002. I started noticing cracks in the exterior walls and the doors and windows became tight. I also had tile crack in my front entry way. I called Beazer to have my foundation checked out and they sent an engineer to inspect my home in 2005.

The inspector noted some movement of the foundation, but said it was not significant enough to justify doing anything at this time. Still concerned that my foundation was failing I called Beazer about six months later. They sent an engineer to inspect the house again, but this time they offered to fix the damage in the entry way. They did so, it was a nasty dirty project, but they replaced all of the tile. It appears they may have used the wrong kind of adhesive with the tiles - they cracked again about sixty days later.

About a month ago I followed up on the situation. They sent another engineer, more movement was noted on the house than previously noted. The ten year "warranty" is being denied as their position is that the foundation has not yet "failed" (even though the house has a crack running diagonally beneath it. While it has not officially "failed" yet, they say no action is warranted. They know that work will be required in the future, but will not do anything to avoid it now.
