Fraud and Scare tactics

My claim is regarding what i feel is fraud on the part of a company trying to get extra money out of the pocket of a consumer. They are also using fraudulent threatening, scare tactics for me to pay money that is not owed. Wednesday January 28 I received a letter from M & J Management Corp. 9001 n. Meridian Street Indianapolis, IN. 46260 saying: "A balance of $445.00 remains open & seriously past due from your apartment at Stanford Court. Unless payment arrangements are made by January 31, your balance will be transferred to your current unit at Darby Court and rent will not be accepted without payment in full."

This is the first letter I have received regarding any past due amount. Even if I did owe the money, it is unfair to make me pay for this within three days from receipt or they will evict me. How can you evict a family - who has NEVER been late for rent (I have lived in three Sexton Community properties), who has a wife, two kids, and a baby on the way. They want to throw a family out in the street, in the middle of winter, in this economy. Also, the full charges are not warranted.

When I moved in to the apartment complex in 09/07, Lauren (the apartment manager at that time) made and agreement with me (my wife and another employee Jason were present at that time) that for the first year Stanford Court would pay me 10.00 a week to pay for my laundry because my unit did not have a washer and dryer. I agreed to sign the lease on that condition.

I moved into the new apartment, thinking that i would try to make it easy, suggested a key to another apartment (i have a note signed by Jason which gives me the apartment number and says that we will try to find an apartment closer) that has a washer/dryer so i can do my laundry. I wasn't satisfied with that because of how poor the washer/dryer was - I then asked for the money. I never received the money... But I never bothered them because they seemed to be good people.

In 05/08 I got married, so i had to upgrade my apartment. I gave the office 30 day notice and moved into another Sexton Community - Darby Court in 06/08 (if i was getting the 10/week they would have so far paid me around $350.00). I was told by the new manager - Jared - that i would owe a transfer fee. I disputed this on the grounds that THEY actually owed ME money. I talked to Jared a number of times (each time having to call three times just to get a return call). He said he was going to check into this and call me back. He did and i told him about my paper signed by Jason regarding the agreement. He then said he will call corporate. I NEVER heard back from him. He had my cell phone number and my work number. I also left him two messages to call me back to make sure this was taken care of. I never heard anything from him or Sexton. You would think, since I moved into another Sexton Community that i wouldn't be that hard to find.

Which brings me back, almost SEVEN months later i get a letter saying i owe them money or i will be evicted? First, i believe i should be given ample time to pay any debt. I should have also have been given a credit for the money owed to me based on the agreement. I feel that Sexton is ripping me off to make an extra buck... Especially since i am STILL PAYING THEM RENT for another apartment... I am actually paying 150% more than i was.
