Federal Alarms & Monitronics: Take money from consumers monthly but perform no service!

We signed an agreement on July 6 for free installation of a security system with a contract to pay for monitoring services for a period of 36 months.in approximately September I came home one day to find my alarm system making an obscenely loud high pitch noise and a "fault 02" flashing on my security system. I immediately went outside and phone Monitronics to correct the issue. They were unable to correct it from their end and informed me that they would be in touch with Federal Alarms to have a technician come out and inspect our system.

Two weeks later I called Monitronics again to inform them that a technician has not been in contact with me and that I would like a refund for the month that my system has not been working. A couple of weeks after that I called Federal Alarms directly to inform them of the issue, they again told me a technician would be in contact with me shortly. A technician called me approx. 2 days later to tell me that he was back logged and unable to come to my house and fix the system. I contacted Federal Alarms again the last week of November to tell them that the issue has not been resolved and that I would like reimbursement for the months the system has not been working. They informed me that they hired a new technician and he would be in contact with me the first week of December to resolve the problem. I called Federal Alarms on March 3 to again state that nothing has been resolved on their end and that I would like to cancel my agreement, I was told that someone would contact me to discuss the "options".

On March 6th I called again to inquire on the status of my cancellation and was told I can cancel if I pay the balance of the contract which is approx. $1,000. After discussing the numerous issues that I have had I was told that yet again someone would contact be later in the day in light of these issues. I called Federal Alarms again on March 8th to cancel and was told that I can not cancel since I signed a contract and that a service technician would be in contact with me to fix the system and that they would credit previous months.in the meantime I contacted Monitronics to see if there was anything they could do on their end but they seemed to be unable to find our agreement in the system. When I told Federal Alarms that Monitronics has no record of our agreement I was told that Monitronics had cancelled it because they have not received signal from our house in over 6 months. During this time Federal Alarms has still been taking monthly payments out of our checking account for something that is not working. I have made numerous attempt to uphold our end of the contract to no avail.

All I am seeking is cancellation of services that are currently not being provided by Federal Alarms and reimbursment for the months that we have paid for service that has not been working. Everytime I have called the answer that I ususally get is that I signed a binding contract and if I truely want to cancel service I would be forced to paid the remainder of the contract.

I have been in contact with this company several times since filing the complaint. They have told me that they need to get the alarm in working order before they can proceed further and have instructed me that Ken in service will contact me to set an appointment. As of yet I have received no phone call or seen anyone at my house and I called two weeks ago.

On Monday April 7th, I called yet again to find out what is going on. I was informed that they were going to be in contact with the president of the company to find out how to clear the account. I was to receive a call on the 8th to find out what was decided. It is now the 11th and still no call. I will be calling yet again today to find out what is going on. They have a habit of saying anything possible to get you off the phone and seem like they genuinely care but never follow through. They are continuing to debit our account every month even though we have not had monitoring service since late August.

I want immediate cancellation of my contract due to faulty equipment and failure to uphold their end of the contract. I would like it stated in writing from the company that our agreement is null and void and that the consumer is no longer liable to uphold their end of the agreement due to failure to perform on the companies part. I am seeking a refund in the amount of $400 for charges incurred while the system has been inoperable as well as a credit for the outstanding balance of $1,000 to cancel service and clear our account.
