William "Bill" Purcell (one of the partners) of Adare Homes (a Colorado company) had us write the earnest money check to him vs Adare Homes on a investment property we were looking to do with Adare. The property did not appraise for the selling price and we terminated the contract and requested our earnest money back, per the contract. Bill kept telling us the check was in the mail.
After getting a lawyer involved he did write us a partial payment check for 10K which bounced, out of his personal acount of course. We have a judgement against him and Adare Homes but to this day we have not seen a dime. Beware of this builder.
We have another case agains Adare Homes for the sum of 160K for default on a promissory note we did a construction loan for.
Adare Homes also defaulted on a Model Home Lease Back we did with them. The lease agreement was for 24 months and Adare defaulted on their payments within the 6th month. Thats another lawsuit in process.
The just of the story is Adare Homes and William Purcell seem to be in the practice of ripping off thier clients. To this day we have not seen a dime of any of the judgments. Anybody know a good collection attorney?
