Slow service, failure to comply with codes, threatening phone calls & mail

I hired Speigle Roofing to repair damage to my house which was caused by last year's hurricanes. When the Salesman, Beau Welch, came out to give me an estimate, he was very friendly, and told me what a great company they were. (Serving Florida for over thirty years, no complaints, and so forth.)

He gave me an estimate, which was in line with what my insurance company had allowed for repairs, so I signed a contract with Speigle. This was on March 3.

From that point, it took one month until materials were delivered to my house. The shingles, plywood, tar paper and other supplies then sat in the yard for two weeks. During this time I never heard from the company or their representative.

Finally, Mr. Welch called to tell me that they needed to have a carpenter assess damage to the fascia and soffits, and that the carpenter would call. I never received a phone call. The next day, Mr. Welch again told me that the carpenter would call, but I heard nothing. Mr. Welch then called to tell me that they had problems with the first carpenter, and he would get someone else.

A couple of days later, Mr. Welch came to my house with Delroy, the carpenter. They looked at the house and decided what had to be done to repair the fascia and soffit. During this inspection, Mr. Welch told me that I would have to go out and purchase Visqueen plastic to cover the roof in case it rained after the old shingles were removed. He further told me that they would need to rent a trailer to haul off the debris, and that I would have to pay $200.00 for this.

I pointed out that the contract included removal of debris, and told him that I was not going to give him any money out of pocket for this. He told my that I could get this money back from the insurance company. When I still refused, Mr. Welch dropped his request for money.

After about three more days, the work began, and was completed on the third day after that. The crew who did the work left several bags of old shingles, bundles of new shingles, tar paper, plywood, 2x4s and an empty can of roofing cement in my yard. There were also some pallet on which the materials had beed delivered. A few days later, an inspector from the Orange County Building Dept.inspected the job and failed it, due to the fact that the starter strip was not cemented down, as called for in the county building code.

I called Mr. Welch to report this, and he said that they would take care of it. Meanwhile, I had received an invoice from Speigle Roofing for the amount of $5880 for the repairs. I told Mr. Welch that the mortgage holder had the money from my insurance settlement in escrow, and that when the job was properly completed and passed inspection, Speigle would get paid. Mr. Welch told me "That's not how it works. You have to pay us and if anything else is wrong, we'll take care of it."

I told him that since I had had to wait so long for everything, I did not believe him. He then became very threatening, telling me that he was going to file a lien against my house. He also left a voice mail message telling me that he was "taking it to the next level" and by the time he got done, I would be living in my car.

In the meantime, I had contacted the Orange County Building Dept. And was advised by them not to pay until the roof passed inspection.

Supposedly the mistakes have been corrected, and as of this date, June 3, we are still waiting for the reinspection. Speigle has received a partial payment of $2126.00, but I will not pay the balance until the job passes.in addition, repeated calls to Mr. Welch about picking up the leftover materials and debris have proved to be unsuccessful. He keeps promising to get this done, but then nothing happens.
