Ripoff sold (stole) my trade-in before I was financed and asked me to commit fraud by changing my W-2's

I entered a contract for a Ford Explorer from Tustin Toyota. They accepted $1,000 as down and gave me $2250 as a trade for my car.

A little more than a month after the contract, I was contacted by them regarding my financing and was told that it did not go through.

I asked Mario, the GM about my trade-in. He was very rude and irritated that I called him and told me he had other customers to take care of.

I was finally told that the reason my financing did not go through was due to income verification. You see, I am self - employed and they said, I did not produce enough documentation to prove my income.

Again, I called Mario and asked him what is it that I need to provide to prove my income. I told Greg (salesman) that I only had my bank statements at the signing, and asked if that would be acceptable. He said yes. I sent a fax to your finance guy Fazi, a day after I signed for the car asking if the information was sufficient. He never responded. I even left a couple of voice messages. He never responded.

Mario said I would need to provide W-2's stating my income. I told him, but your application asked for my income (which I interpreted) to mean current income. My W-2's will not show my current income, as I explained.

Mario then suggested I have my accountant falsify my W-2's. I was shocked! I asked him why would I do that? He said, so you can show that you have enough income in order to be financed. I couldn't believe he asked me to do this. I told him, there is no way I'm going to falsify my W-2's.

So, later, I met with Greg, and asked again, where is my car? He said, they could not find it and to go ahead and keep the Explorer until they can check a few more options for financing.

A week passed and I didn't hear from them, so I called and talked with Greg who told me to come in and Chris will take care of issuing me a check as per my contract. You mean my invalid contract?

My question was, how can you now inforce a contract that is no longer valid?

I told Chris in Finance that I wanted Kelley Blue Book for my car and my down in return for the car or my down plus a car in like, kind, and class as my trade, or a car in like, kind, and class as my trade in exchange for the down and all considerations of my trade.

He said NO! They were only going to give me my $1,000 down and the $2250.00 as per contract.

I asked what happened to my car and he said they sold it at an auction for less than they were giving me.

I told Chris that I came there with a vehicle paid off and $1,000.00 cash, and I expect to leave their dealership the same way, not oweing them and not being owed by them.

He said they were contacting the police and he had them in his office and they were going to reposess the car I entered into contract with them on. He then accused me of fraud. Telling me that "I" was the one who had falsified the appliction and they were going after me for fraud. He then added, that "I" was looking for loop holes in the contract. If that isn't that cat calling the kettle black?

I will never do business with another Toyota Dealership. They are so smooth, and then they blame "you" when the contract doesn't go through and act as if everything is your falt. When I asked about my car, they made it seem as if they didn't have time to do the research and they didn't really care where it was.

Now that they have sold my car "illegally", they want to blame me for it and file a police report.

I just want to be made whole again. I want to leave, the same way I came, with my $1,000.00 down and a running vehicle in likeness, kind and class.

I do not want enter into another contract with this Dealership ever! I just want to leave the same way I came... Not with a bus pass!
