I WAS rear ended by a semi doing in excess of 75 mph due to the driver adjusting his air conditioner in december according to the deposition. My vehicle was turned over twice spun around 3 times on I 75 and hit a tree in the median, i was taken to the hospital for treatment,
I want to leave you with my personal experiences with this law firm and after due reflection feel they did not do an adequate job so beware if you retain this first rate firm,
I guess a good thing about this firm was they settled in abut 2 years
My attorney was david goldman, he told me the settlement would"allow me to buy many cars so do not worry about getting a replacement. He also told me he would be my primary attorney throughout the case, not true he saddled me with a new attorney without asking either my thoughts or permission to do this, I did not like this attorney either personnally or professionally and i reallly do not like being lied to about how long your going to personally represent me!!!
To the best of my knowledge goldman was going through a divorce so you be the judge but you know life is tough!!!
During the deposition the new attorney did a really lousy job of fending off a particulary non essential element that had he objected would have in my opinion as an MBA allowed me to receive more money but their are absolutely stupid attorney's everywhere!
Let me leave you with a thought here, they are getting over 33% of your money so in my mind they TOTALLY work for us not vice versa one must remember this at all times!!!
My major problem was at the mediation table, in my opinion they attempt to make you believe the mediator is impartial but "on your side a little more than the other guy's" please do not buy into this they are all lawyers and all they really want is MONEY! I do not believe from my extensive experience they could care less about you!
At the crucial mediation stage the owner of the firm Mr david Shapiro was absolutely impatient I made the huge mistake of putting my trust in him shame on me! Long story short When I left the mediation room it was my understanding and i confirmed it with David goldman that the payout to me would be (i will make up a number but the intent is same) $100,000 but a few days after the settlement the firm called and said it was $75,000 (the point of the numbers is that there was a $ 25,000 difference in what i heard and what they said and they said well they changed their minds and there was no turning back the point is when you finish the settlement mediation process get the final number agreed on in WRITING
I should have noticed the trouble sign of the firm owner acting very impatient meaning not really caring about the outcome he had a better place to be than with me.
Most hurtful is the way mr. Goldman and mr shapiro yelled back at me " you misunderstood
Trust me as a senior army officer and with this much money and my future well being at stake i did not MISUNDERSTAND!!!
Don't be scared to go to trial!!!
Finally and most importantly do not think you are going to get a windfall! In florida to get (according to the mediator I had) your average car rear end payout is about 20,000 you better have a major operation from a a specialist to get twice that amount and you better have some damning statements on your opposition
Oh and you better not be on meds, or have had any accidents because your own attorneys will tell you at the very end of the process this is why your getting squat!!!
Remember the (YOUR) attorneys usually get about as much as you will, them don't forget the letters of protection from the medical guys
And it might be a good ideal (please check with an attorney on this) to exclude your wife from the lawsuit (you really need to explore this)
So do your research and check with a lic attorney because the only way you get a windfall in Florida is if you are truly truly seriously mained or crippled
Please ask your lawyer to show you what you can reasonably expect after all the other people are payed
I am not a lawyer this has been my experience with a so called top law firm and i can prove this
so just do your homework and do not be afraid to ask these suits questions and be totally tough on them they are counting on you being awed by them and not to ask informed questions
