Mark ripoff, repo car with only two payments left, said missing payment from Nov 03, repo in May 04

My husband purchased a car from Newmarket Motors in July. We made our payments every month either by cashiers check or money order. On Monday, May 17th the finance manager from the lot came to our house and drove off in the car. I heard the car start up ran to the window and flagged him to stop. He waved at me and drove away with the car and all my husbands belongings. On Tuesday morning I called to find out why the car had been picked up. To my surprise they stated that we were behind on our payment.

When I asked how come they didn't call they stated that our phone number had been changed so they assumed we were skipping out on the car payment. My second question was why they didn't contact my husband at work since they had that number and got no response. I also asked why if the November payment was the one they were missing did they wait until May to repo the vehicle. Again no response.

We immediately went down to the lot with money order / cashier check receipts in hand and had them go through there ledger. November's payment had not been posted as was Aprils. I had purchased a money order for November & cashiers check for April. I was told that we needed to have the cancelled money order receipts and he would adjust the balance.

I contacted Travelers and was told it could take 30 - 60 days to recieve the copies. Mark, the manager / owner, told me that I could pay the new balance of $1163, which included a $432 repo fee and get the car back and he would reimburse me after the money order was traced. My husband needed to get his things out of the car and the finance manager gave them to him in a paper bag.

Today is Friday and we still have not recieved any type of written correspondence from them stating the balance, how many days they will hold the car, etc. Everytime I call now Mark seems to be unavailable. I have an appointment with a lawyer on Monday afternoon because I've been told that they have not proceeded legally with this repossession and that they should waive my repo fee, legally should have sent me a statement within 3 days of the repo and also itemized the contents of the vehicle.

Do not deal with this lot. The individuals seem nice when you first get there but in the end will try and wring every possible dime out of you. I wish someone had warned me about them before we went through them. The only reason my husband financed it was because he was trying to build some credit because we paid cash for our two other cars.

By the way does anyone have any information about VA repo law. I have bits and pieces of information from several lawyers and a repo company that I called to get information.
