Ex-employee who was robbed by the company

Do to an injury I was forced to retire early from my career. Needing something to do I decided to sell cars to meet people, and work on my communication skills. I answered an ad and went to work for Midway as a salesman. It wasn't at all what I thought, but they said give it six months before I make a decision if I like it or not. I gave it the six months, and it only got worse.

The scheduling was only posted to make things look legal. They would force people to come in on their days off, and force salesman to stay sometimes beyond fourteen hours a day. It wasn't asking to stay it was stay or lose your job. The only way to make money was to be on the floor and sell cars, and at times they would not let people be on the floor at all. I was forced to stay at work 10 to 12 hours on an average and not get paid. Thats not my complaint, it was my choice to stay in that slave pit for six months, so I have no right to complain about that.

Gm has incentive programs for their employees. If a person sold certain vehicles, or a certain amount of vehicles they would pay you a bonus. When you qualified for a "spin" a wheel would be spun for you on gm's website and the number it landed on was the amount of the bonus you would recieve. During the months of Feburary March and April of last year my spin amount was $2100. Gm would send each check individually so I was suppose to recieve 6 checks. The month of April was my seventh month, and I didn't want to stay in that business, so I quit on April 10th and moved back to Tucson to be closer to my children. When I left I gave them a fowarding adress to mail my checks to.

Around late May, early June I called Midway and talked to Jackie to ask about my checks I hadn't recieved. She informed me that since I quit I'm not eligable to recieve those checks. They are sent to the dealership with my name on them, that doesn't make sense. She told me thats just the way it is and nothing anyone can do about it.

Two weeks ago, one year later, I recieved a form 1099-misc in the mail gm telling me I had to pay taxes on $900 from the "spins". They had a number on the back so I called it to see what this was about. I had to file taxes, so I went ahead and claimed it. Today gm returned my call telling me that they cant find info on the $900, but there were checks totaling $1200 that were cashed in early May of last year. I then checked my paystubs with my w2, and yes there was an extra 1200 reported on the w2. Since those checks are mailed to the dealership with my name, and only my name on them, somebody at Midway forged and cashed my checks. Gm is going to send me the cashed checks (might take forever) but I will get this straightend out.in the meantime I'm out the $400 I had to pay the irs. I will be filing criminal charges against Midway, and telling everyone I can think of how they ripped me off.
