September 01 traded our Isuzu Rodeo in for a Kia Sedona. Salesmen Adam & Daniel informed us that they called our previous leasing company, Wells Fargo (WF) and obtained the payoff figure.
We asked both Adam and Daniel two times if they contacted WF and they said yes. I asked, "And this will get us out of the lease we're in?" We were told yes.
We were presented with the figures and signed the paperwork and drove off in our new van.
Three weeks later I received a collections notice from WF Leasing on the Isuzu. Surely it had crossed in the mail and they have received payment from Peoria Kia. I called Wells Fargo and no, they had not received any payment and that I was turned over to collections. I informed them that we traded the car into Peoria Kia, however that was of no help to them, I am the responsible party for the Rodeo as far as they are concerned (understandably).
I contacted Craig at Peoria Kia, and his comment to me was, "Has anyone from here called you yet?". I told him no. Well, apparently the payoff for the Isuzu was approximately $4800 more than they 'figured'. Although being told previously at the sale they called WF, now they apoligize, they did not in fact call, they used their 'best guess'. We were responsible for the difference, to try to add it to our new loan, or pay the difference. If we didn't pay the difference we would be taken to court.
We explained that we wanted no part of the deal, that we will come in to pick up the Rodeo and give them back the van. First they tried to 'find' the Rodeo and then they informed us that the Rodeo was sold showing an invoice to another no-name dealership.
How can they sell a vehicle they hadn't even paid for? They told us, "Well we can, if there's an intent to pay..."
After much hagling with Jim Henry, Sales Mgr. The only way we could get WF satisfied was to go in and sign a new finance contract adding just over $1000 to our original figure. Several days after this, they paid WF.
