In February of I was involved in a motor vehicle accident in which another driver INTENTIONALLY swerved his vehicle directly in front of mine and slammed on the brakes. I reported it to the CHP and to my insurance company, Mercury Insurance.
I filled out an accident report with the CHP and gave my statement to a representative of Mercury Unsurance. Shortly thereafter, I received a notice from Pamela Infantas of Mercury's claims department saying that they had determined that I was 100% at fault for the accident because I had rear-ended the other driver.
This was before they had even sent someone to inpsect the damage on my vehicle, and as far as I know before anyone had even contacted the other party involved in the accident.
Talk about adding insult to injury. I was already upset about the damage to my car, the disruption to my life - not to mention the fact that I could have been injured or killed by the criminal actions of another driver who intentionally tried to cause me to crash. Now Mercury Insurance was telling me that I was 1. A lousy driver 2. A bold-face liar, and, of course, that it would result in an increase in my insurance premium. None of these is acceptable.
Either Ms.infantas is incompetent or this amounts to a deliberate attempt on the part of the insurance company to intimidate and humiliate its customer making a valid claim. I am sure there are probably many customers who would lie down and take it and just accept the insurance company's determination saying, "you can't fight the insurance companies". I will not take this lieing down. I will fight until a suitable determination is made and the other party is forced to pay and hopefully charged criminally and taken off of the road. The other driver is a road-raged maniac and is a threat to everyone on the road.
